ORDINANCE NO. 24-79 BY: Magnotto, McBride, Wendling, Brockman, Brown, Chinnock AFl EMERGENCY ORDINANCE to supplement the Building Code of the Codified Ordinances of the City of Lakewood by enacting new Chapter 1321 of the Building Code relating to the licensing of electricians and heating and air-conditioning contractors and repealing all other ordinances or parts of ordinances inconsistent herewith. WHEREAS, this ordinance constitutes an emergency measure providing for the preservation of the public safety and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Building Code of the Codified Ordinances of the City of Lakewood be supplemented by enacting new Chapter 1321 of the Building Code which shall read as follows: CHAPTER 1321 LICENSING OF ELECTRICIANS AND HEATING AND/OR AIR-CONDITIONING CONTRACTORS 1321.O1 LICENSING REQUIREMENT a) No person, corporation, partnership, firm or other business association shall, acting in the capacity of a contractor, engage in heating and/or air-conditioning work or electrical work for which a permit is required without first obtaining a license for each trade from the Building Commissioner. b) Contractor, for the purpose of this section, means any person, corporation, partnership, firm or other business association who performs any work specified above for consideration evidenced by an oral or written agreement. No corporation, partnership, firm or other business association shall engage in work for which a license is required, unless at least one responsible member, officer or employee of such corporation, partnership, firm or other business association has been licensed pursuant to this Chapter. All work performed by such corporation, partnership, firm or other business association shall be under the direct supervision of the licensed person. 1321.p2 APPLICATION a) Applications for a license shall be on a form issued by the Buildin9 Commissioner. Such licenses shall be 9ranted if the Buiidin9 Commissioner finds the applicant is qualified to perform the work for which the application is sought. b) Evidence that the applicant is currently licensed by a city or county which, in the opinion of the Buildin9 Commissioner has a qualified examination, shall be sufficient evidence of qualifi- cation so as to authorize the issuance of a license. Evidence that the applicant has served an apprenticeship in a trade union and passed all necessary requisites of the electrical union which, in the opinion of the Building Commissioner demonstrate the applicant's ability to perform work in compliance wi th all appi ical)le codes and ordinances, shall I)e sufficient evidence of qualification so as to authorize the issuance of a license,
