ORDINANCE NO. 100-81 <br /> <br /> PLEA~ SUBSTITDTE FOR ORDINANCE <br /> REFERRED TO FINA~ICE COMMITTEE <br /> ON NOVEMBER 2, 1981 <br />BY:Brown, Chinnock, Gallagher, Graham, <br /> McBride, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to amend Sections 911.Oi and. 911.02 and to repeal <br />Section 911.03 of the Streets and Public Services Code of the Codified Ordin- <br />ances of the City of Lakewood, relating to charges for use of the Lakewood <br />incinerator and hours of operation. <br /> WHEREAS, due to the closing of the Lakewood incinerator and the <br />necessity of having to haul all refuse to a landfill site it is necessary to <br />implement new and appropriate charges for all refuse brouaht to the Lakewood <br />incinerator, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety, and welfare, and <br />for the usual daily operation of a municipal department; now, therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That Section 911.01 of the Streets ~and Public Services <br /> Code of the Codified Ordinances of the City of Lakewood now reading as follows: <br /> 911.01 HOURS,-OF OPERATION; AUTHORITY OF DIRECTOR OF PUBLIC WORKS. <br /> The Lakewood incinerator, located at 12920 Berea Road, shall <br /> be open for operations between the hours of 8:00 a.m. and 4:30 <br /> p.m., Monday through Friday, and 8:00 a.m. to 11:30 a.m. on <br /> Saturdays. The Director of Public Works has discretion to <br /> vary these hours as he deems necessary. In addiction, the <br /> Director of Public Works is hereby authorized to establish <br /> limits on both the quality and quantity of refuse, garbage, <br /> .and other material.s brought to the Lakewood incinerator for <br /> incineration. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />911.Ol HOURS OF OPERATION; AUTHORITY OF DIRECTOR OF PUBLIC WORKS <br /> <br />(a) The Lakewood incinerator, located at 12920 Berea Road <br />shall be open for collections between the hours of 8:00 a.m. <br />to 3:00 p.m., Monday through Friday, and shall be closed on <br />Saturday, Sunday and legal holidays. <br /> <br />(b) The Director of Public Works is hereby authorized to vary <br />the hours of operation as he deems necessary and to establish <br />limits on both the quality and quantity of refuse, garbage, <br />and other materials brought to the Lakewood incinerator. <br /> <br />(.c) The Director of Public Works is hereby authorized to <br />establish rules and regulations for the pick up and collection <br />of refuse, garbage and other materials by the Service Department <br />of the City. <br /> <br /> Section 2. That Section 911.02 of the Streets and Public Services <br />Code of the Codified Ordinances of the City of Lakewood, now reading as follows: <br /> <br />911.02 CHARGES. <br />(a) Residents of the City and owners of businesses situated in the <br />City who bring refuse, garbage and other waste materials arising out <br />of the use of their place of residence or business, to the Lakewood <br />incinerator in their own vehicles may make use of the incinerator <br />without charge. <br />(b) A charge shall be made for all materials brought to the incin- <br />erator by, for or on behalf of contractors and commercial haulers <br />as follows: minimum fee of five dollars ($5.00) for up to 600 <br />pounds plus one dollar ($1.00) for each additional 100 pounds or <br />fraction thereof. <br /> (c) No refuse, garbage or other waste material arising out of the <br /> use of premises located outside of the City shall be accepted at <br /> the Lakewood incinerator. <br /> <br /> <br />
