ORDINANCE NO. 70 -81 By: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Salmon, <br /> Wendling <br /> An emergency ordinance to provide for the submission to the <br />electorate of an amendment to Article III, Section 2 of the Amended <br />Charter of the City of Lakewood, pertaining to the requirement than <br />members of the Council elected from wards of the City be residents of <br />the ward from which they are elected. <br /> <br /> WHEREAS, an emergency exists in that this proposed Charter <br />amendment is to be presented to the electorate of the City of Lakewood <br />at the general election no be held on'November 3, 1981; and <br /> <br /> WHEREAS, for the foregoing reason, this ordinance constitutes <br />an emergency measure providing for the immediate preservation of the <br />public health, safety and welfare; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO, ~fO~THiRDS OF ALL MEMBERS ELECTED THERETO CONCURRING: <br /> <br /> Section 1. That the question of the amendment to Article III, <br />Section 2 of the Amended Charter of the City of Lakewood, so that as <br />amended the same shall be and read as follows: <br /> <br />ARTICLE III. THE COUNCIL. <br /> <br />SECTION 2. QUALIFICATIONS AND VACANCIES. <br /> <br /> All members of Council shall be electors of the City, and <br />each member of Council elected from a ward of the City shall <br />be a resident of the ward from which such member was elected. <br />Any member who ceases to possess this qualification shall <br />forthwith forfeit his office. Vacancies in Council shall be <br />filled by the remaining members thereof, provided that in the <br />evenn Council does no% so appoinn by a majority of its remain- <br />ing members within sixty (60) days of the creation of the <br />vacancy, the Mayor shall be empowered to fill such vacancy. <br />Such appointee shall hold office for the unexpired term of the <br />member in whose office the vacancy occurs or until his succes- <br />sor is elected and qualified. A successor shall be elected ag <br />the next regular municipal election, provided that such vacancy <br />occurs more than two years and one hundred and five days (2 <br />years and 105 days) prior to the date of such election. <br />However, if any vacancy results from a recall election the <br />vacancy shall be filled in the manner provided by this Charter. <br /> <br />(Upon adoption of this amended Section, the existing Article <br />III, Section 2 of the Amended Charter of the City of Lakewood <br />shall be repealed.) <br /> <br />be submitted to a vote of the qualified electors of the City at the <br />general election to be held on Tuesday, the 3rd day of November, 1981 at <br /> <br /> <br />
