ORDINANCE NO. 70 -81 By: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling An emergency ordinance to provide for the submission to the electorate of an amendment to Article III, Section 2 of the Amended Charter of the City of Lakewood, pertaining to the requirement than members of the Council elected from wards of the City be residents of the ward from which they are elected. WHEREAS, an emergency exists in that this proposed Charter amendment is to be presented to the electorate of the City of Lakewood at the general election no be held on'November 3, 1981; and WHEREAS, for the foregoing reason, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO, ~fO~THiRDS OF ALL MEMBERS ELECTED THERETO CONCURRING: Section 1. That the question of the amendment to Article III, Section 2 of the Amended Charter of the City of Lakewood, so that as amended the same shall be and read as follows: ARTICLE III. THE COUNCIL. SECTION 2. QUALIFICATIONS AND VACANCIES. All members of Council shall be electors of the City, and each member of Council elected from a ward of the City shall be a resident of the ward from which such member was elected. Any member who ceases to possess this qualification shall forthwith forfeit his office. Vacancies in Council shall be filled by the remaining members thereof, provided that in the evenn Council does no% so appoinn by a majority of its remain- ing members within sixty (60) days of the creation of the vacancy, the Mayor shall be empowered to fill such vacancy. Such appointee shall hold office for the unexpired term of the member in whose office the vacancy occurs or until his succes- sor is elected and qualified. A successor shall be elected ag the next regular municipal election, provided that such vacancy occurs more than two years and one hundred and five days (2 years and 105 days) prior to the date of such election. However, if any vacancy results from a recall election the vacancy shall be filled in the manner provided by this Charter. (Upon adoption of this amended Section, the existing Article III, Section 2 of the Amended Charter of the City of Lakewood shall be repealed.) be submitted to a vote of the qualified electors of the City at the general election to be held on Tuesday, the 3rd day of November, 1981 at
