ORDINANCE N0.74 -81 <br /> <br />By: Brown, Chinnock, Gallaqher, <br /> Graham, McBride <br /> <br /> An emergency ordinance to provide for the submission to the <br />elec~orare of an amendment to Article VII, Section 1 of the Amended <br />Charter of 5he City of Lakewood, pertaining to the duties of the Direc- <br />tor of Law. <br /> <br /> ~HEREAS, an emergency exists in that this proposed Charter <br />amendment is to be presented to the electorate of the City of Lakewood <br />at the general election to be held on November 3, 1981; and <br /> <br /> WHEREAS, for the foregoing reason, this ordinance constitutes <br />an emergency measure providing for the immediate preservatmon of the <br />public health, safety andwelfare; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEW00D, STATE <br />OF 0HI0, TWO-THIRDS OF ALL MEMBERS ELECTED THERETO CONCURRING: <br /> <br /> Section 1. That the questmon of the amendment to Artmcle VIIs <br />Section 1 of the Amended Charter of the City of Lakewood, so that as <br />amended the same shall be and read as follows: <br /> <br />ARTICLE VII. DEPARTMENT OF LAW. <br /> <br />SECTION I. QUALIFICATIONS AND DUTIES OF DIRECTOR. <br /> <br /> The Director of Law shall be an attorney at law admitted <br />to practice in the State of Ohio, and shall be an elector of <br />the City. He shall be the legal advisor of and attorney and <br />counsel for the City, and shall advise, counsel, and draft <br />legislation at the direation of any member of Council, the <br />Mayor and any director of an administrative department, or on <br />the request of any board or commission of the City in matters <br />relating to their official duties. He shall prepare all <br />contracns, bonds and other instruments ~n writing in which the <br />City is concerned and shall endorse on each h~s approval of <br />the form and correctness thereof. He shall appoint such <br />assistants and assign their duties as Council may authorize. <br /> <br /> (a) The Director of Law shall be the Prosecuting Attor- <br />ney of the Municipal Court. He may designate such number of <br />assistant prosecutors as the Council by ordinance may author- <br />~ze. He shall prosecute all cases brought before such Court <br />and perform the same duties so far as they are applicable <br />thereto, as are required of the Prosecuting Attorney of the <br />County. <br /> <br /> (b) When required to do so by resolution of the Council, <br />the Director of Law shall prosecute or defend for and in <br />behalf of the City, all complaints, suits and controversies in <br />which the City is a party, and such other suits, matters and <br /> <br /> <br />
