0RDIN~NCE NO. 76--81 By: Brown, Chinnock, Gallagher, Graham, McBride, Wendling An emergency ordinance to provide for the submission to the electorate of an amendment to Article XI, Section 9 of the Amended Charter of the City of Lakewood, perta~nzng to enactments not subject to referendum. WHEREAS, an emergency exists in that this proposed Charter amendment is to be presented to the electorate of the City of Lakewood at the general election to be held on November 3, 1981; and WHEREAS, for the foregoing reason, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO, TWO-THIRDS OF ALL MEMBERS ELECTED THERETO CONCURRING: Section 1. That the question of the amendment to Article XI, Section 9 of the Amended Charter of the City of Lakewood~ so that as amended the same shall be and read as follows: ARTICLE XI. REFERENDUM. SECTION 9. ENACTMENTS NOT SUBJECT TO REFERENDUM. Notwithstanding any provisions to the contrary in Sections 1, 11 or 12 of Article XI of thzs Charter or any other provz- sions of this Charter, ordinances or resolutions enacted as emergency measures for the following purposes shall not be subject to referendum: (a) To appropriate money for any lawful purpose; (b) To create, revzse or abolish departments or to provide regulations for their government; (c) To aethorize the appoznnment of employees zn any of the departments; (d) To authorize, or otherwise affecting, the issuance of bonds, notes or o~ber debt instruments of the City; (e) To authorize a contract for a public improvement or an expenditure of money, which contract is to be paid or expenditure is to be made, in whole or part, from the proceeds of bonds, notes or other debt instruments of the City; and (f) To provide for the payment of operating expenses of any department o~ the City.
