ORDINANCE NO. 83-81 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE authorizing and directing the Mayor to purchase certain real property located at 1440 Belle Avenue, hereinafter more particularly described~ WHEREAS, the Hospital Board of Trustees five-year plan included a recommen- dation that suitable property in the Hospital vicinity be acquired as it becomes available for future requirements of the Hospital's present programs and facilities, and WHEREAS, the Hospital Administration has established a property acquisition policy which requires consultation with the Mayor, Chairman of the Hospital Board of Trustees' Finance Committee and the Chairman of the City Council Hospital Committee prior to an offer being made by the Hospital to the property owner, and WHEREAS, an approved offer was made to the property owner and said property owner has accepted same, and WHEREAS, the Board of Trustees of Lakewood Hospital by Resolution 582, adopted July 28, 1981, requested COuncil adopt appropriate legislation authori- zing the acquisition oF the subject property for future Hospital expansion, and WHEREAS, this ordinance constitutes an emergency measure providing fir the immediate preservation of the public safety and welfare and for the usual daily operation of a municipal department and for the further reason that the owner has agreed to sell said property for the consideration herein stipulated and this Council determines it to be in the best interest of the City that the property be purchased as soon as possible. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor be and he is hereby authorized and directed to purchase from Margaret M. Ryan the following described property: And known as being the Northerly 43.50 feet of Sub Lot No. l0 in the Belle Allotment as shown by the recorded plat in Volume 41 of Maps, Page 23 of Cuyahoga County Records, and being 43.50 feet front on the Westerly side of Belle Avenue, and extending back 162.07 feet on the Northerly line, about 162.18 feet on the South- erly line, and having a rear line of 47.51 feet, as appears by said plat, be the same more or less, but subject to all legal highways. and to pay therefor the sum of Sixty Seven Thousand Dollars ($67,000.00). Section 2. That the titl~ to said property shall be subject to the approval of the Director of Law; tha{ taxes and assessments shall be prorated as of the date of the filing of the Deed for record using the last available tax rate and valuation for computing tax prorations; that the Director of Finance be and he is hereby authorized to pay the amount set forth in Section 1 hereof from the Hospital Fund upon delivery by the Grantors of a good and sufficient
