ORDINANCE NO, 85-81 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendllng <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor to purchase <br />certain real p~operty located at1463 Belle Avenue, hereinafter more particu- <br />larly described. <br /> <br /> WHEREAS, the Hospital Board of Trustees five-year plan included a recommen- <br />dation that suitable property in the Hospital vicinity be acquired as it becomes <br />available for future requirements of the Hospital's present programs and <br />facilities, and <br /> WHEREAS, the Hospital Administration has established a property acquisition <br />policy which requires consultation with the Mayor, Chairman of the Hospital <br />Board of Trustees' FinanCe Committee and the Chairman of the City Council <br />Hospital Committee prior to an offer being made by the Hospital to the property <br />owner, and <br /> WHEREAS, an approved offer was made to the property owners and said <br /> property owners have accepted same, and <br /> <br /> WHEREAS, the Board of Trustees of Lakewood Hospital by Resolution 592, <br /> adopted August 25, 1981 requested Council adopt appropriate legislation authori- <br /> zing the acquisition of the subject property for future Hospital expansion, and <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br /> the immediate preservation of the public safety and welfare and for the usual <br /> daily operation of a municipal department and for the further reason that the <br /> owners have agreed to sell said property for the consideration herein stipulated <br /> and this Council determines it to be in the best interest of the City that the <br /> property be purchased as soon as possible. <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That the Mayor be and he is hereby authorized and directed <br /> to purchase from Frank K, Ziegenruecker and Margaret M. Ziegenruecker the <br /> following described property: <br /> <br /> Situated in the City of Lakewood, County of Cuyahoga, <br /> State of Ohio, and being known as Sublot No. 122 in the <br /> Belle Avenue Allotment of parts of Original Rockport Town- <br /> ship Section No. 22 as shown by the recorded plat in <br /> Volume 41 of Maps, Page 23 of Cuyahoga County Records, <br /> and being 45 feet front on the easterly side of Belle <br /> Avenue (60 feet wide), 187.72 feet deep on the southerly <br /> line, 187.83 feet deep on the northerly line and 45 feet <br /> in the rear, as appears by said plat, be the same more <br /> or less, but subject to all legal highways, and further <br /> known as 1463 Belle Avenue, together with all buildings <br /> and appurtenances thereon and appurtenant thereto or <br /> thereon in their present condition. <br /> and to pay therefor the sum of Eight Two Thousand Dollars ($82,000.00). <br /> Section 2. That the title to said property shall be subject to the <br /> approval of the Director of Law; that taxes and assessments shall be prorated <br /> as of the date of the filing of the Deed for record using the last available <br /> tax rate and valuation for computing tax prorations; that the Director of <br /> Finance be and he is hereby authorized to pay the amount set forth in Section <br /> 1 hereof from the Hospital Fund upon delivery by the Grantors of a good and <br /> sufficient Warranty Deed to the City of Lakewood, together with guarantee of <br /> title disclosing the said real estate to be free and clear of all encumbrances <br /> <br /> <br />
