<br />AN EMERGENCY OROINANCE to amend Sections 1769.01 and 1769.04 of the
<br />Sanitary Code of the Codified Ordinances of the City of Lakewood to prohibit the
<br />keeping of common pigeons.
<br />
<br />WHEREAS, common pigeons cause damage to roofs, gutters and other
<br />portions of homes and create ,other nuisances which should be controlled by
<br />prohibiting the keeping of same, and
<br />
<br />WHEREAS, common pigeons are not a protected species pursuant to the
<br />provisions of 1533.07 of the Ohio Revised Code, and
<br />
<br />WHEREAS, to specifically prohibit the keeping of common pigeons will
<br />serve as an additional tool in the enforcement of problems created by pigeons,
<br />and
<br />
<br />WHEREAS, this ordinance constitutes an emergency measure providing for
<br />the immediate preservation of the public health and welfare and for the usual
<br />daily operation of a municipal department; now, therefore,
<br />
<br />BE IT OROAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO:
<br />
<br />Section 1. That Section 1769.01 of the Sanitary Code of the Codified
<br />Ordinances of the City of Lakewood now reading as follows'
<br />
<br />1769.01 CERTAIN ANIMALS PROHIBITED.
<br />
<br />Subject to the provisions of Section 1769.04, no person shall
<br />keep any bovine, sheep, goat, swine, fowl, rabbit or any other
<br />animal or fowl, except horses, mules, donkeys, dogs, cats and
<br />other animals and fowl of the domesticated variety, upon any
<br />premises not directly connected with any part of a slaughtering
<br />estab 1 i shment.
<br />
<br />shall be and the same is hereby amended to read as follows:
<br />
<br />1769.01 CERTAIN ANIMALS PROHIBITED.
<br />
<br />Subject to the provisions of Section 176.9.04, no person shall
<br />keep any bovine, sheep, goat, swine, fowl., common pigeon other
<br />than homing pigeon, rabbìt or any other animal or fowl, except
<br />horses~ mules, donkeys, dogs, cats and other animals and fowl
<br />of the domesticated variety, upon any premises not directly
<br />connected with any part of a slaughtering establishment.
<br />
<br />Section 2. That Section 1769.04 of the Sanitary Code of the Codified
<br />Ordinances of the City of Lakewood now reading as follows:
<br />
<br />1769.04 ANIMAL E~CLOSURES; LIMITATIONS ON RAISING FOWL.
<br />
<br />No rabbit hutch, goat pen, chicken coop, runway, yard or other
<br />place for the keeping of any rabbit, goat, chicken, goose, turkey,
<br />or fowl of any kind, shall be maintainéd or suffered to exist
<br />in the City. No live rabbit, chicken, duck, goose, turkey, or
<br />other fowl shall be raised or kept in the City, except that fowl
<br />for the purpose of killing or sale in the ordinary course of
<br />business may be kept in crates, provided that:
<br />
<br />(a) Every such crate is maintained ina clean condition;
<br />(b) Every such crate is kept upon a watertight floor or påve-
<br />ment that is thoroughly flushed with water daily; and
<br />(c) No crate containing or use to contain live fowl is kept in
<br />the ·same '"'"room in whi ch food other than 1 i ve fowl is prepared,
<br />placed, kept or sold.
