ORDINANCE NO. 42-83 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE to amend Paragraph (c) and enact new subpara- graph (h) and (i) and to reletter subparagraph (h) of 529.02 of the General Offenses Code of the Codified Ordinances of the City of Lakewood pertaining to distribution and consumption of intoxicating beverages to persons under the age of 21 years. WHEREAS, this Council is of the opinion that further regulation is necessary relating to adults knowingly permitting minors to violate State liquor laws and the provisions of Chapter 529 o~the General Offenses Code of the Codi- fied Ordinances of the City of Lakewood, and WHEREAS, it is the opinion of this Council that there should be provision for citation of those persons under the age of nineteen (lg) years who consume beer on private property, and WHEREAS, it is the intent of this Council to supplement the State of Ohio liquor laws relating to minors and not to conflict with same, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare and for the usual operation of a municipal department; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That subparagraph (c) of Section 529.02 of the General Code of the Codified Ordinances of the City of Lakewood now reading as Offenses follows: 529.02 SALES TO MINORS; PROHIBITIONS AND MISREPRESENTATION. shall be (b) . . . (c) No person under the age of nineteen years shall order, pay for, share the cost of, or attempt to purchase any be~r or intoxicating liquor, or consume any beer or intoxicating liquor, either from a sealed or unsealed container or by the glass or by the drink, in any public place except as provided in subsection (a) hereof. and the same is hereby amended to read as follows: 529.02 SALES TO MINORS: PROHIBITIONS AND MISREPRESENTATIONS. (b) . . . (c) No person under the age of nineteen years shall order, pay for, share the cost of, or attempt to purchase any beer or intoxicating liquor, or consume any beer or intoxicating liquor, either from a sealed or unsealed container or by the glass or by.the drink unless given by a physlcl? in the regular line of his practice, or by the parent or legal quard~an of such person. Section 2. That Section 529.02 of the General Offenses Code of the Codified Ordinances of the City of Lakewood shall be and the same is hereby supplemented by enacting new subparagraph (h) to read as follows: (h) No person being the parent or legal guardian of a minor shall knowingly permit such minor to violate any provision of this Chapter.
