ORDINANCE NO. 61-83 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor to purchase <br />certain real property located at 1450 Belle Avenue, hereinafter more parti- <br />cularly described. <br /> <br /> WHEREAS, the Hospital Board of Trustees five-year plan included a <br />recommendation that suitable property in the Hospital vicinity be acquired <br />as it becomes available for future requirements of the Hospital's present <br />programs and facilities, and <br /> <br /> WHEREAS, the Hospital Administration has established a property acqui- <br />sition policy which requires consultation with the Mayor, Chairman of the <br />Hospital Board of Trustees' Finance Committee and the Chairman of the City <br />Council Hospital Committee prior to an offer being made by the Hospital to <br />the property owner, and <br /> <br /> WHEREAS, an approved offer was made to the property owner and said <br />property owner has accepted same, and <br /> <br /> WHEREAS, the Board of Trustees of Lakewood Hospital by Resolution 758, <br />adopted April 26, 1983 requested Council adopt appropriate legislation <br />authorizing the acquisition of the subject property for future Hospital <br />expansion, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for <br />the immediate preservation of the public safety and welfare and for the <br />usual daily operation of a municipal department and for the further reason <br />that the owner has agreed to sell said property for the consideration <br />herein stipulated and this Council determines it to be in the best interest <br />of the City that the property be purchased as soon as possible. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby authorized and directed <br />to purchase from Philip G. Phillips the following described property: <br /> <br />Situated in the City of Lakewood, County <br />of Cuyahoga and State of Ohio and known <br />as being Sublot No. 12 in the Belle Avenue <br />Allotment of part of Original Rockport <br />Township Section No. 22 as shown by the <br />recorded plat in Volume 41 of Maps, Page <br />23 of Cuyahoga County Records and being <br />45 feet front on the westerly side of <br />Belle Avenue and extending back 162.31 <br />feet on the northerly line, 162.44 feet <br />on the southerly line and having a rear <br />line of 45.01 feet, as appears by said <br />plat. <br /> <br />and to pay therefor the sum of Seventy Thousand Dollars ($70,000). <br /> <br /> Section 2. That the title to said property shall be subject to the <br />approval of the Director of Law; that taxes and assessments shall be pro- <br />rated as of the date of the filing of the Deed for record using the last <br />available tax rate and valuation for computing tax prorations; that the <br />Director of Finance be and he is hereby authorized to pay the amount set <br /> <br /> <br />
