ORDINANCE NO. 76-83 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to amend Sections 1703.14 and 1783.05 of the <br />Sanitary Code of the Codified Ordinances of the City of Lakew~od and to adopt <br />new Sections 1783.22 and 1783.23 of the Sanitary Code of the Codified Ordinances <br />and new Sections 505.13 and 52].16 of the General Offenses Code of the Codified <br />Ordinances of the City of Lakewood. <br /> <br /> WHEREAS, this Council feels it is necessary to prQtect the rights of <br />the citizens from the accumulation of garbage, rubbish, litter and debris, and <br /> <br /> WHEREAS, Council has created the Clean Community System for the <br />enforcement of Litterless Lakewood, and <br /> <br /> WHEREAS, the Ohio D~partment of Litter Control has provided funding <br />for a litter enforcement officer, and <br /> <br /> WHEREAS, it is necessary to amend and adopt ordinances for the better <br />enforcement of the goals for a cleaner City, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety, and welfare, and <br />for the usual daily operation of a municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 1703.14 of the Sanitary Code of the Codified <br />Ordinances of the City Of Lakewood, now reading as follows: <br /> <br /> 1703.14 GARBAGE. <br /> <br />"Garbage" means the animal and vegetable waste resulting <br />from the handling, preparation, cooking and consumption of <br />food. ; <br /> <br />shall be and the same is hereby amended to read as follows: <br /> 1703.14 GARBAGE, REFUSE, LITTER. <br /> <br /> "Garbage',, "refuse", or"litter"means the animal and vege- <br />table waste resulting from the handling, preparation, cooking, <br />and consumption of food, or the subtances as set forth in Sec- <br />tion 521.08 of the General Offenses Code; or solid waste ac- <br />cumulations consisting of garbage, household trash, yard de- <br />bris, and business trash; or all discarded man-made materials <br />including but not limited to waste materials, building <br />materials; trash, refuse, and yard debris. <br /> <br /> Section 2. That Section 1783.05 of the Sanitary Code of the Codified <br />Ordinances of the City of Lakewood, now reading as follows: <br /> <br />1783.05 RECEPTACLES FOR GARBAGE. <br /> <br />Except where other suitable measures for the disposal of gar- <br />bage have been provided, the Owner, agent, lessee or occu- <br />pant of any building where garbage is produced or permitted <br />to accumulate, shall provide one or more receptacles there- <br />for and shall maintain such receptacle in good condition so <br />that the same will not leak. Each such receptacle shall be <br />made of Suitable material, watertight, shall be provided <br />with a closely fitting cover, shall have a capacity of not <br />less~than five nor more than ten gallons and shall be <br />provided with suitable handles. <br /> <br /> <br />
