<br />.,"'...." <br /> <br />" <br /> <br />ORDINANCE NO. 4-85 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br />McBride, Salmon, Wendling <br /> <br />AN EMERGENCY ORDINANCE supplementing the Building Code of the Codified <br />Ordinances of the City of lakewood by enacting new Chapter 1333 entitled <br />Dish-Type Satellite Signal-Receiving Antennas. <br /> <br />WHEREAS, the City of lakewood is aware that dish-type antennas are be- <br />coming more available for use to receive satellite radio and television <br />signals, and <br /> <br />WHEREAS, it is the desi re of lakewood City Counci 1 to permit the use <br />by property owners of thei r property, subject to reasonable regul ati ons and to <br />protect the rights of other property owner, and <br /> <br />WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety, and welfare, and <br />for the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF lAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That the Building Code of the Codified Ordinances of the <br />City of lakewood shall be and the same is hereby supplemented by enacting new <br />Chapter 1333 to read as follows: <br /> <br />CHAPTER 1333 <br />DISH-TYPE SATEllITE SiGNAL-RECEIVING ANTENNAS <br /> <br />1333.01 DEFINITIONS. <br /> <br />As used in this Chapter: <br /> <br />(a) "Dish-type Satellite Signal-Receiving Antennas," also <br />referred to as "earth stations" or "ground stations" shall <br />mean one or a combination of two or more of the following: <br /> <br />(1) A signal-receiving device (antenna, dish antenna, <br />or di sh-type antenna), the purpose of whi ch is to recei ve <br />communication or other signals from satellites in orbit and <br />other extra-terrestrial sources. <br /> <br />(2) A low-noise amplifier (lNA) which is situated at <br />the focal poi nt of the recei vi ng component and the purpose <br />of whi ch is to magnify, store, transfer and/or transmit <br />electronic or light signals. <br /> <br />(3) A coaxi a 1 cable the, purpose of whi ch is to carry <br />or transmit said signals to a receiver. <br /> <br />(b) "Receiver" shall mean a television set or radio receiv- <br />er. <br /> <br />(c) "Dishll shall mean that part of a satellite signal re- <br />ceiving antenna characteristically shaped like a saucer or <br />dish. <br /> <br />(d) IIGrounding rod" shall mean a metal pole or rod perman- <br />ently positioned in the earth to serve as an electrical con- <br />ductor through which electrical current may safety pass and <br />dissipate. <br /> <br />1333.02 PERMIT REQUIRED. <br /> <br />No person, firm, partnership, corporation, trust, or <br />other 1 ega 1 entity shall construct, assemble or erect an <br />earth station without a permit, nor shall such construction, <br />assembly or erection commence before a permit is issued in <br />accordance with Section 1333.03 of this Chapter. <br />
