ORDINANCE NO. 61-85 Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EHERGENC¥ ORDINANCE providin8 for the submission to the electors of the City of a proposed rmendmant to the Amended Charter of the City of Lakevood to mmend Sections 6,, 8, 9 ~nd 11 of Article IX to require that declarations and petitions of c~ndidacy be filed with the election authorities seventy-five (75) days prior to the day of the primary election, and to otherwise require that declarations and petitions of candidacy, the'form of the ballot at the City's primary, special and regular municipal elections and the qualification of electors shall be determined by the election authorities in accordance vith the general lays of Ohio. liHEREAS, pursuant to the ABended Charter of the City and the Constitution of the State of Ohio, the Council has datarmined to authorize and direct the submission to the alectors of the City of Lakevood of the proposed Charter amendment hereinafter sat forth, at the general and regular municipal election to be held on November 5, 1985, vhich election is not less than 60 nor more tJmn 120 days from the date of passage of this ordinance; and I~HEREAS, this Council by two-thirds vote of the me.bets elected thereto determines that this ordinance is an emergency measure which is necessary for the immediate preservation of the public peace, property, health and safety and for the further reason that this ordinance must be immediately effective in order to permit the election herein called to be held on the date specified in this ordinance; NO~, THEREFORE, BE IT ORDAINED by the Council of the City of Lakewood, Cuyahoga County, Ohio: Section 1. That this Council hereby authorizes and directs the submission to the electors of the City of Lakevood at the general and regular municipal election to be held at the usual places of voting in the City on Tuesday, November 5, 1985, of the folloving proposal to amend the Amended Charter of the City. That Sections 6, 8, 9 ond 11 of Article IX of the Amended Charter of the City of Lake~ood be maended to read as follovs: SECTION 6. DECLARATIONS OF CANDIDACY. Candidates for the offices of Nayor and member of Council shall, not later than four p.m. of the seventy-fifth day before the day of the primary election, file a declaration and petition of candidacy as required by the general lm~s of the State of Ohio, Except as otherwise required by this Charter, the general Laws of Ohio shall govern the following matters: (i) the number of signatures on and the filing of declarations and petitions of candidacy; (ii) the manner of circulation of declarations and petitions of candidacy; (iii) the availability for public inspection of declarations and petitions of candidacy and (iv) the protest against the candidacy of any person.
