Placed on First Reading: Oct. 62 1986 <br />Placed on Second Reading: Oct. ~, 1986 <br /> <br />ORDINANCE NO. 103-86 <br /> <br />BY: Gallagher, Graham, McBride, <br /> Wendling <br /> <br /> AN ORDINANCE to amend Section 1121.08 of the Zoning Code of <br />the Codified Ordinances of the City of Lakewood to permit the parking <br />of educational trailers and educational vehicles in certain zoning <br />districts of the City as a special exception. <br /> WHEREAS, this Council deems it to be appropriate and in the <br />best interest of the City to permit the parking of educational <br />trailers and educational vehicles in certain zoning districts of the <br />City as a special exception subject to certain conditions and <br />restrictions; now, therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO: <br /> <br /> Section 1. That Section 1121.08 of the Zoni~g Code of the <br />Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />1121.08 SPECIAL EXCEPTION PARKING <br /> <br />The Board of zoning Appeals may permit as a Special <br />Exception with approval of City Council the use of <br />land in the R1, R2, M1 and M2 district contiguous <br />to a BR-Business/Residential, BI-Office, and X- <br />Industrial district for off-street parking spaces <br />for customers and employees, provided it finds the <br />conditions hereinafter specified are met: <br /> <br />(a) <br /> <br />(b) <br /> <br />(c) <br /> <br />(d) <br /> <br />(e) <br /> <br />(f) <br /> <br />The proposed parking lot will be contiguous <br />to a BR, Bi or X District. <br />The Board shall hold a public hearing on the <br />request and written notice shall be mailed to <br />all property owners within 200 feet of <br />proposed lot stating property involved, time, <br />date, and place where hearing will be held. <br />The Board shall determine that the applicant <br />is the owner or owner's agent of the property <br />in question and that the owner will, in <br />writing, agree to comply with such conditions <br />and restrictions as may be imposed by the <br />Board and all applicable ordinances. <br />The Board affirmatively finds that the <br />proposed parking use, subject to such <br />conditions and restrictions as it may impose, <br />will not result in substantial detriment to <br />neighboring property. <br />In establishing conditions and restrictions, <br />if any, the Board shall consider, for the <br />protection of the neighborhood, the length of <br /> time for construction, maintenance, <br /> screening, fences, walls, landscaping, <br /> lighting, evening use, need for landscape <br /> space 15 feet wide between sidewalk and <br /> parking lot, and uses other than parking for <br /> customers and employees, provided that the <br /> design of the proposed parking area has been <br /> approved by the Architectural Board of <br /> Review. <br /> If City Council fails to concur with the <br /> recommendations of either or both the <br /> Architectural Board of Review and the Board <br /> of Zoning Appeals, then it will direct the <br /> matter back to the appropriate Board. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br /> <br />
