ORDINANCE NO. 29-86 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to appropriate a portion of the <br />property situated at 1276 Clifton Prado, Lakewood, Ohio, (Permanent <br />Parcel No. 312-29-105). <br /> WHEREAS, on the 18th day of February, 1986, the Council of <br />the City of Lakewood, Ohio adopted Resolution No. 6030-86 declaring <br />the necessity and intention of appropriating the land hereinafter <br />described, notice of ~the adoption of which Resolution has been served <br />on the owners, persons in possession or having an interest of record <br />in said land, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the usual daily operation of a municipal department and <br />for the immediate preservation of the public property, health and <br />welfare; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO: <br /> <br /> Section 1. That the fee simple interest and to the <br />following described real estate be and the same is hereby appropriated <br />for the purpose of constructing a roadway open to the public without <br />charge in the City of Lakewood, Ohio, in conjunction with the Clifton <br />Prado Improvement Project of the City: <br /> <br />Being a portion of the premises situated in the <br />City of Lakewood, County of Cuyahoga and State of <br />Ohio, at 1276 Clifton Prado, Lakewood, Ohio <br />bearing Permanent Parcel ~312-29-105 and further <br />described as follows: <br /> <br />Parcel 1: Beginning at the northeasterly corner <br />of a parcel of land conveyed to Edna M. Wick and <br />Viola M. Schafer by deed recorded in Volume 7070, <br />Page 567 of Cuyahoga County Official Records; <br />thence West, 11.50 feet along the northerly line <br />of said parcel; thence South, 40.65 feet to the <br />southerly line of said parcel; thence East, 11.50 <br />feet along said southerly line to the <br />southeasterly corner thereof; thence North, 40.65 <br />feet along the easterly line of said parcel to the <br />place of beginning and containing 0.01073 of an <br />acre of land as calculated and described by <br />William J. Haas, P.S. #4793 for the City of <br />Lakewood from a survey made in July, 1984 by James <br />B. Root and Associates. <br /> <br />Parcel 2: An Undivided one-twentY second interest <br />in the following described premises: Situated in <br />the City of Lakewood, County of Cuyahoga and State <br />of Ohio and known as being part of Sublots Nos. 54 <br />and 55, and part of a 20 foot alley in the Henry <br />Beach Subdivision of part of Lot No. 60 in <br />Original Rockport Township, Section No. 21, as <br />shown by the recorded plat in Vol. 30 of Maps, <br />Page 4 of Cuyahoga County Records and together <br />forming a parcel of land bounded and described as <br />follows: Beginning at a point on the Easterly line <br />of Beach Avenue, due South 216 feet measured along <br />said Easterly li~e from the Southwesterly line of <br />Clifton Boulevara, said point being also the <br />intersection of said Easterly line with the <br />Southerly line of a 20 foot driveway, 235.13 feet <br /> <br /> <br />
