ORDINANCE NO. 87-86 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE authorizing and directing the Mayor e~-officJo~, Pi~e~t~r_ ~f Public Safety to issue a permit to Geiger[s- Haberdasher~':, ~..~. %o conduct a sidewalk sale a~ 14710 Det~oit.:~venue:- on Thursday, July24; Friday, July 25 ; and Saturday, July 26, 1986j between the hours of l0 a.m. and 6:00 p.m. WHEREAS, this ordinance constitutes an emergency measure providing f=F· thu usu=l daily operation of a municipal department; mow, therefore, OHIO: BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE ~F Section 1. That notwithstanding the provision of Section 1667.17 of the Regional Building Code and the provision of Section 901.18 of the Streets and Public Services Cede of the Codified Ordinances of the City of Lakewood, the Mayor, as ex-officio O~rector of Public Safety, be and he is hereby authorized and directed to issue a ~ermit to ~eiger's Haberdashery to conduct a sfde~alk sale at :[~710 Det~oit'~v~nu~ x in the City on Thursday, July 24; Friday, July '25~ and Saturday, July 26, between the hours of lO:O0 a.m. and 6:00 p.m. No more than fifty per cent (50%) of the sidewalk width abutting participating stores shall be occupied by displays, which occupied portion of the sidewalk shall be that portion immediately adjacent to the principal structure. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons stated in thepreamble hereof and provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law.
