Brown, GallLag~ G~aham, McBride, Salmon,- Wendling e'oz . recognized the need. a portion of public-- West ll7th Street, Line to Edgewater WHEREAS, This road improvement is part of a larger project which is the repair and resurfacing of West ll~th Street, from Bellaire-.Road to Edgewater Drive in the the Cities of Cleveland and Lakewood, and WHEREAS, this ordinance is hereby decl-ared to be an emergency ordinance immediately necessary fo~ -the preservation of the public peace, heal~h, and safety, and for the further reason th'at it is necessary to expedite the preparation of the plans and specifications for the improvement; now,-therefore; BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAK~WOOD, COUNTY OF CUYAHOGA AND STATE OF OHIO: Section 1. ~ONSENT That it is declared to be in the public interest that the consent of said MUNICIPALITY be and such ~onsent is hereby given to the COUNTY and the Ohio Department of Transportation to construct the above described improvement in accordance with plans, specifidations and estimates approved by the COUNTY. Section 2. COOPERATION That the MUNICIPALITY will cooperate with the COUNTY and the Ohio Department of Transportation in the repair and resurfacing of West llTth Street from the Lakewood South Corporation Line to Edgewater Driv~ .- That the MUNICIPALITIES will arrange for the preparation of construction plans and specifications including necessary engineering repor~ts for - improvement under current Cuyahoga County Engineer standards for construction of County roads and bridges. That the COUNTY will arrange for the supervision and administration of the construction contract. Section 3. FUNDING m e That the MUN!CIPALIT~ hereby agrees to participate with the COUNTY in the cost of the improvement by an allocation from the COunty Motor Vehicle $5.00 License Tax Fund to pay the COUNTY portion of the project. That if the project is financed as a Federal-aid Highway project, eligible costs of the improvement shall be financed from the aforesaid funds. Fo~ the area between the Lakewood South Corporation Line to Lake Avenue, within the corporate limits of the MUNICIPALITY, the MUNICIPALITY shall contribute ten percent (10%) of the costs of construction, construction supervision, and incidentals and forty percent (40%) of the costs of preparation of plans and specifications, exclusive of the items set forth in Section 7-3 and Section 8-1. For the area between Lake Avenue and Edgewater Drive, within the corporate l~imits of the MUNICIPALITY, the MUNICIPALITY shall contribute fifty percent (50%) of the cost of construction, construction supervision, and incidentals, and forty percent (40%) of the costs of preparation of plans and specifications, exclusive of the items set forth in SectiOn 7-3 and Section
