<br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor,
<br />Ex-Officio Director of Public Safety, to enter into an amendment to the
<br />agreement which established the Westshore Council of Governments for the
<br />cities of Bay Village, Ohio; Rocky River, Ohio; Fairview Park, Ohio;
<br />Lakewood, Ohio; North Olmsted, Ohio; and Westlake, Ohio, to provide for
<br />participation in the Westshore Hazardous Material Committee.
<br />
<br /> WHEREAS, the Ohio Revised Code authorizes the legislative authority
<br />of municipal corporations to enter into agreements with other municipal
<br />corporations, upon such terms as are agreed for the services of their
<br />respective Divisions of Fire and Police, or the use of fire and police
<br />equipment, or for the interchange of such services and equipment within the
<br />several territories of the contracting subdivisions; and
<br />
<br /> WHEREAS, in 1971, the aforementioned west shore communities entered
<br />into an original agreement creating the Westshore Council of Governments; and
<br />
<br /> WHEREAS, in order to formally establish the existence of the
<br />Westshore Hazardous Materials Committee, the cities of Bay Village, Ohio;
<br />Lakewood, Ohio; Rocky River, Ohio; Fairview Park, Ohio; North Olmsted, Ohio;
<br />and Westlake, Ohio, must enter into an amended agreement for the
<br />establishment of the Westshore Council of Governments, and
<br />
<br /> WHEREAS, such amendments must be authorized by the respective
<br />legislative authorities and the member communities; and
<br />
<br /> WHEREAS, this ordinance constitutes an emergency measure providin~
<br />for the immediate preservation of the public peace, health, safety and
<br />welfare and for the usual daily operation of municipal departments, and for
<br />the further reason that the provision of mutual aid is determined to be in
<br />the best interests of the citizens of the City' of Lakewood to ensure adequate
<br />safety forces in the event circumstances require the assistance of
<br />neighboring communities' safety forces; now, therefore,
<br />
<br />OHIO:

<br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF
<br />
<br /> Section 1. That ~he Mayor, Ex-Officio Director of Public Safety,
<br />be, and he is authorized and directed to enter into an amendment to the
<br />agreement which established the Westshore Council of Governments between the
<br />cities of Bay Village, Ohio; Rocky River, Ohio; Fairview Park, Ohio;
<br />Lakewood, Ohio; North Olmsted, Ohio; and Westlake, Ohio, to provide for the
<br />participation in the Westshore Hazardous Material Committee--said amendment
<br />being substantially in the form as set forth in Exhibit A, attached hereto,
<br />and made a part hereof;
<br />
<br /> Section 2. It is found and determined that all formal actions of
<br />this Council concerning and relating to the passage of this ordinance were
<br />adopted in an open meeting of this Council, and that all such deliberations
<br />of this Council and of any of its committees that resulted in such formal
<br />action were in meetings open to the public, in compliance with all legal
<br />requirements.

<br /> Section 3. That this ordinance is hereby declared to be an
<br />emergency measure for the reasons stated in the preamble hereof and provided
<br />it receives the affirmative vote of two-thirds of all members elected to
<br />council, it shall take effect and be in force immediately upon its adoption
<br />and approval by the Mayor; otherwise, it shall take effect and be in force
<br />after the earliest period allowed by law.
