PLEASE SUBSTITUTE FOR ORDINANCE NO. 44-89, which <br />was PLACED ON 1ST READING and REFERRED TO PLANNIN( <br />& ZONING CMTE AND PLANNING COMMISS~0N~6~!9/89; an¢ <br />PLACED ON 2ND READING ON 7/17/89. <br /> <br />ORDINANCE NO. <br /> <br />44-89 <br /> <br />BY:Brown, Chinnock, Gallagher, <br />Gazzana, George, Graham <br /> <br /> AN ORDINANCE to amend Sections 1105.07 and 1107.07 of the <br />Zoning Code of the Codified Ordinances of the City of Lakewood. <br /> <br /> WHEREAS, it is well determined that land use control is <br />within the authority of municipal 'government, it is in the interest of <br />all citizens that the Zoning Code be amended from time to time to <br />reflect changes in our city, and <br /> <br /> WHEREAS, the City of Lakewood has begun a process for the <br />complete review of its comprehensive land use plan pursuant to the <br />amended Charter and Codified Ordinances of the City of Lakewood, and <br /> <br /> WHEREAS, the permitted accessory uses under the Zoning Code <br />requires revision from time to time to meet changing conditions in the <br />city, and to fulfill the purposes, goals, and objectives set forth in <br />the Comprehensive Land Use Plan, and <br /> <br /> WHEREAS, this ordinance constitutes a measure providing for <br />the preservation of the public health, safety and welfare, now, there- <br />fore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 1105.07 of the Zoning Code of the <br />Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />1105.07 SIDE YARD REGULATIONS FOR PRINCIPAL BUILDING <br /> <br />The sum of the two side yards shall be no less than 25 <br />feet. Neither side yard shall be less than 10 feet. <br /> <br />be and the same hereby is repealed and amended to read as follows: <br /> <br />1105.07 SIDE YARD REGULATIONS FOR PRINCIPAL BUILDINGS <br />The sum of the two side yards shall be no less than 25 <br />feet. Neither side yard shall be less than 10 feet, <br />except that on existing principal structures with <br />existing side yards of less than 10 feet, an addition <br />may be added provided that the new addition does not <br />encroach further than the foundation sidewalls of the <br />existing principal structure. <br /> <br /> Section 2. That Section 1107.07 of the Zoning Code of the <br />Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />1107.07 SIDE YARD REGULATIONS FOR PRINCIPAL BUILDING <br />The sum of the two side yards shall be not less than 15 <br />feet.
