ORDINANCE NO. 17-90 BY: Boscia, Gallagher, Gazzana, George, Graham, Roth, Smith providing with the therefore, AN EMERGENCY ORDINANCE amending Section 915.02 of the Streets and Public Services code of the Codified Ordinances of the City of Lakwood relating to Homestead Exemptions in water rates. WHEREAS, a Momestead Exemption establishing a minimum service and consumption charge for water to persons 65 years of age or older and to permanently or totally disabled persons is appropriate and in the public interest, and WHEREAS, based on inflation and other factors, it is appropriate that the standard for such exemption be reviewed from time to time, and WHEREAS, the Cuyahoga County Homestead Exemption on real estate taxes has recently been increased to $16,500.00, and WHEREAS, such standard is appropriate in considering the City's water rate Homestead Exemption, and WHEREAS, this ordinance constitutes an emergency measure for the health, safety and welfare of our citizens along usual daily operation of a municipal department; now, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 915.02 of the Streets ~nd Public Services code of the Codified Ordinances of the City of La~ewood, now reading as follows: 915.02 HOMESTEAD EXEMPTION. The Director of Public Works is hereby authorized and directed to establish a special homestead exemption, effective March 1, 1987, whereby a minimum service and consumption charge shall be made to homesteads owned by persons sixty-five years of ~ge or older or by a permanently or totally disabled person, provided that such person's total income is less than fifteen thousand dollars ($15,000) annually. The minimum charge for the first 1,000 cubic feet of water or less used by each homestead during each one or three-month billing period shall be twelve dollars and ninety- three cents ($12.93) beginning March 1, 1989. All water used in excess of 1,000 cubic feet during each one or three-month billing period shall cost 129.3 cents ($1.293) per 100 cubic feet beginning March 1, 1989. be and the same is hereby repealed and amended to read as follows: 915.02 HOMESTEAD EXEMPTION.
