ORDINANCE NO. <br /> <br />70-90 <br /> <br />PLEASE SUBSTITUTE FOR ORDINANCE NO. 70-~C <br />PLACED ON SECOND READING ON 11/5/90. <br /> <br />BY: Boscia, Gallagher, George, <br /> Graham, Roth, Smith <br /> <br /> An emergency ordinance to enact new Chapter 775 of the <br />Business Regulation Code of the Codified Ordinances of the City of <br />Lakewood to permit commercial establishments to conduct sidewalk <br />sales and establishing regulations for same. <br /> WHEREAS, Section 1667.17 cf the Regional Building Code and <br />Section 901.18 of the Streets and Public Services Code of the Codified <br />Ordinances of the City of Lakewood prohibit the use of the Public <br />Right of Way, particularly sidewalks, for the display of merchandise <br />or other similar commercial purpose, unless permitted by ordinance of <br />the City, and <br /> WHEREAS, this Council determines it to be in the public <br />interest to generally permit such sidewalk sales and displays subject <br />to certain regulations and conditions, and <br /> WHEREAS, this ordinance constitutes an emergency measure <br /> providing for the immediate preservation of the public health, safety <br /> and welfare, and for the usual daily operation of a municipal <br /> department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That the Buisness Regulation Code of the <br /> Codified Ordinances of the City of Lakewood shall be and the same is <br /> hereby supplemented by enacting new Chapter 775 to read as follows: <br /> <br />CHAPTER 775 <br /> <br />SIDEWALK SALES. <br /> <br />775.01 PERMITS AND REGULATIONS. <br /> <br />(a) No person, business, partnership, or <br />corporation shall conduct a sidewalk sale, or <br />display goods, wares or merchandise upon the public <br />right of way without first obtaining a permit in <br />writing from the Director of Public Works. <br /> <br />(b) As used in this section, "sidewalk sale" means <br />the exchange or attempted exchange of goods or <br />services for an amount of money, or its equivalent, <br />or the display of goods, wares or merchandise, upon <br />a public right of way. <br /> <br />(c) Notwithstanding the provisions of Section <br />1667.17 of the Building Code of the City of <br />Lakewood and Section 901.18 of the Streets and <br />Public Services Code of the Codified Ordinances of <br />the City of Lakewood, issuance of permits as <br />provided in Section (a) of this section shall be <br />upon forms provided by the Director of Public works <br />and submitted for approval to both the Director of <br />Public Works and the Director of Public Safety. <br /> (1) The application shall be accompanied by <br /> a fee of Five ($5.00) Dollars. <br /> (2) No permit shall exceed a period of seven <br /> (7) consecutive days, and a separate <br /> permit shall be required for each <br /> business address; <br /> (3) The sidewalk sale or display shall be <br /> conducted only upon the public right of <br /> way adjacent to the business address of <br /> the applicant; <br /> (4) The occupied portion of the sidewalk <br /> shall be that portion immediately <br /> <br /> <br />
