BY: AN EMERGENCY ORDINANCE to supplement the Fire Prevention Code of the Codified Ordinances of the City of Lakewood by the enact- ment of new Chapter 1502 to regulate the inspection of underground storage tanks. WHEREAS, new Ohio Revised Code statutes have changed the provisions relative to the installation, testing, and removal of underground storage tanks throughout the State of Ohio, and WHEREAS, the State Fire Marshall has adopted permanent Rule 1301:7-9-15 of the Ohio Administrative Code which delegates authority to local fire departments for the inspection of underground storage tanks, and WHEREAS, local fire departments may take over such authori- ty to inspect underground storage tanks if an Ordinance is adopted by Council authorizing its fire department to inspect and issue written permits for the installation of, the making of major repairs on site to, abandonment of, and removal of underground storage tanks, as that term is defined in Rule 1301:7-7-02 of the Ohio Administrative Code, and WHEREAS, this Council determines it to be in the best interest of the City to authorize local inspection of such under- ground storage tanks by the enactment of new Chapter 1502 to supple- ment the Fire Prevention Code of the Codified Ordinances of the City of Lakewood, and WHEREAS, this ordinance Constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare, and for the usual daily operation of a municipal depart- ment; now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Fire Prevention Code of the Codified Ordinances of the City of Lakewood is hereby supplemented by the enactment of new Chapter 1502 to read as follows: CHAPTER 1502 Storage Tanks 1502.01 AUTHORIZATION FOR INSPECTION OF UNDER GROUND STORAGE TANKS BY LAKEWOOD FIRE DEPARTMENT; INVENTORY OR COMBUSTIBLE RECORDS FOR UNDERGROUND STORAGE OF FLAMMABLE LIQUIDS. (a) Ohio Administrative Code Permanent Rule 1301: 7-9-15 enables the State Fire Marshall to delegate to local fire departments the authority to conduct inspections of underground storage tanks for compliance with State regulations concerning installations, repairs, upgrades and removals. The Lakewood Fire Department is authorized to perform such inspections and is empowered to obtain authority from the State Fire Marshall to issue delegated underground storage tank permits which are required to be obtained from the State Fire Marshall by owners and operators of under- ground storage tanks. (b) Ohio Administrative Code Rules Sections 1301: 7-9-06, 07 and 08, are hereby incorporated herein by reference and all property owners in the City of Lakewood must be in compliance therewith. 1
