NU. /,J-~l <br />PLACED ON FIRST READING AND REFERRED TO THE <br />COMMITTEE OF THE WHOLE ON g/3/g]. <br /> BY: <br /> <br /> AN EMERGENCY ORDINANCE to supplement the Fire Prevention <br />Code of the Codified Ordinances of the City of Lakewood by the enact- <br />ment of new Chapter 1502 to regulate the inspection of underground <br />storage tanks. <br /> <br /> WHEREAS, new Ohio Revised Code statutes have changed the <br />provisions relative to the installation, testing, and removal of <br />underground storage tanks throughout the State of Ohio, and <br /> <br /> WHEREAS, the State Fire Marshall has adopted permanent Rule <br />1301:7-9-15 of the Ohio Administrative Code which delegates authority <br />to local fire departments for the inspection of underground storage <br />tanks, and <br /> <br /> WHEREAS, local fire departments may take over such authori- <br />ty to inspect underground storage tanks if an Ordinance is adopted by <br />Council authorizing its fire department to inspect and issue written <br />permits for the installation of, the making of major repairs on site <br />to, abandonment of, and removal of underground storage tanks, as that <br />term is defined in Rule 1301:7-7-02 of the Ohio Administrative Code, <br />and <br /> <br /> WHEREAS, this Council determines it to be in the best <br />interest of the City to authorize local inspection of such under- <br />ground storage tanks by the enactment of new Chapter 1502 to supple- <br />ment the Fire Prevention Code of the Codified Ordinances of the City <br />of Lakewood, and <br /> <br /> WHEREAS, this ordinance Constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare, and for the usual daily operation of a municipal depart- <br />ment; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Fire Prevention Code of the Codified <br />Ordinances of the City of Lakewood is hereby supplemented by the <br />enactment of new Chapter 1502 to read as follows: <br /> <br /> CHAPTER 1502 <br />Storage Tanks <br /> <br />1502.01 AUTHORIZATION FOR INSPECTION OF UNDER <br />GROUND STORAGE TANKS BY LAKEWOOD FIRE DEPARTMENT; <br />INVENTORY OR COMBUSTIBLE RECORDS FOR UNDERGROUND <br />STORAGE OF FLAMMABLE LIQUIDS. <br /> <br />(a) Ohio Administrative Code Permanent Rule 1301: <br />7-9-15 enables the State Fire Marshall to delegate <br />to local fire departments the authority to conduct <br />inspections of underground storage tanks for <br />compliance with State regulations concerning <br />installations, repairs, upgrades and removals. <br />The Lakewood Fire Department is authorized to <br />perform such inspections and is empowered to <br />obtain authority from the State Fire Marshall to <br />issue delegated underground storage tank permits <br />which are required to be obtained from the State <br />Fire Marshall by owners and operators of under- <br />ground storage tanks. <br /> <br />(b) Ohio Administrative Code Rules Sections 1301: <br />7-9-06, 07 and 08, are hereby incorporated herein <br />by reference and all property owners in the City <br />of Lakewood must be in compliance therewith. <br /> <br />1 <br /> <br /> <br />
