ORDINANCE NO. 6 - 92 <br /> <br />BY: Boscia, Gallagher, George, <br />Gibbons, Roth, Seelie, Smith <br /> <br /> AN EMERGENCY ordinance to vacate two portions of the public <br />right-of-way situated at the north end of Clifton Prado, in the City ~ <br />of Lakewood, Ohio. <br /> WHEREAS, on October 21, 1991, Council adopted Resolution <br />No. 6647-91 declaring its intent to vacate two portions of the public <br />right-of-way situated at the north end of Clifton Prado, and <br /> WHEREAS, notice of the adoption of the above Resolution No. <br />6647-91 has been served upon the owners of all of the properties <br />abutting Clifton Prado affected by said Resolution, notifying said <br />property owners of the time and place at which objections could be <br />heard before the Board of Revision of Assessments, and <br /> WHEREAS, on January 7, 1992, the Board of Revision of <br />Assessments approved vacation of two portions of the public right-of- <br />way situated at the north end of Clifton Prado hereinafter more <br />particularly described in accordance with the provisions of Article <br />XIV, Section 28 of the Amended Charter of the City of Lakewood, and <br /> WHEREAS, Council is satisfied that there is good cause for <br /> vacating two portions of the right-of-way situated at the north end <br /> of Clifton Prado and that it will no't be detrimental to the general <br /> interest of the public, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br /> providing for the immediate preservation of the public health, safety <br /> and welfare, and for the usual daily operation of a municipal depart- <br /> ment; now, therefore, <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That the following described property be and <br /> the same is hereby vacated: <br /> <br /> PARCEL A: Situated in the City of Lakewood, <br /> County of Cuyahoga and State of Ohio and known as <br /> being part of original Rockport Township Lot No. <br /> 60, Section 21 and further bounded and described <br /> as follows: beginning at the Northerly Monument <br /> in the Clifton Prado, (23 feet in width), as shown <br /> by the dedication plat recorded in Volume 239, <br /> Page 52 of Cuyahoga County Map Records; thence due <br /> West a distance of 11.50 feet to a point; said <br /> point being on the Westerly right-of-way of Clif- <br /> ton Prado; thence North along the Westerly right- <br /> of-way of Clifton Prado; thence due North along <br /> the Westerly right-of-way of Clifton Prado a <br /> distance of 11.00 feet to a point, said point <br /> being the Northeast corner of Permanent Parcel No. <br /> 312-29-099 as shown by the aforesaid plat; thence <br /> due West along the North line of Permanent Parcel <br /> No. 312-29-099 a distance of 56.07 to a point, <br /> said point being the Northwest corner of Permanent <br /> Parcel No. 312-29-099 and also being~the principal <br /> place of beginning; thence due North a distance of <br /> 19.15 feet to a point of curvature; thence South- <br /> easterly along the arc of a circle deflecting to <br /> the right a distance of ~40.90 feet, said arc <br /> having a radius of 40.00 feet and a chord which <br /> bears South 60 degrees, 42' 19" East, 39.14 feet <br /> to a point; thence due West along the North line <br /> of Permanent Parcel No. 312-20-099 a distance of <br /> 34.14 feet to the principal place of beginning, be <br /> the same more or less, but subject to all legal <br /> highways. <br /> <br /> <br />
