PLEASE SUBSTITUTE FOR ORDINANCE NO. 5-93, <br />PLACED ON FIRST READING & REFERRED TO CMTETOF <br /> WHOLE ON 3/15/93. <br /> <br />ORDINANCE NO. 5 - 9 3 <br /> mx: Boscia, Gallagher, George, <br /> Gibbons, - i, Seetie, Smith <br /> AN EMERGENCY ORDINANCE providing for the stud~ and designation of <br />Improvement Target Areas within the City of Lakewood, in connection With <br />carrying out programs in such areas pursuant to the Housing and Community <br />Development Act of 1974, as amended, and related matters. <br /> <br /> WHEREAS, pursuant to the City's home rule powers granted under <br />Article XVIII, Section 3 of the Constitution of the State of Ohio, and pur- <br />suant to the Charter and ordinances of the City of Lakewood, the City has the <br />power to carry out various programs and activities designed to eliminate or <br />prevent the spread or occurrence of deteriorated conditions in deteriorated <br />and deteriorating areas of the City of Lakewood; and <br /> <br /> WI~EREAS, in order to preserve and protect existing residential and <br />co~ercial areas within the City of Lakewood, the City has heretofore been <br />working effectively to carry out various activities and programs in designated <br />Improvement Target Areas, and has made progress toward the elimination or the <br />prevention of the spread or occurrence of deteriorated conditions in said <br />areas; and <br /> <br /> WHEREAS, because of the existence of concentrations of aged struc- <br />tures, the City desires to continue such activities and programs, and the City <br />desires to provide for the designation of additional Improvement Target Areas <br />from time to time, as hereinafter provided; and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure necessary <br />for the imm~ediate preservation of the public service, welfare and safety, for <br />the reason that it is necessary to provide for the designation of Improvement <br />Target Areas in the City in order to carry out programs for the elimination <br />and prevention of the spread or occurrence of deteriorated conditions and <br />areas within the City; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. For the purpose of this Ordinance, the following terms <br />shall have the meanings ascribed to them in this section, unless a different <br />meaning is clearly indicated in the context: <br /> <br />(a) "Charter" shall mean The Amended Charter of the City <br /> of Lakewood, Ohio. <br /> <br />(b) "City" shall mean the City of Lakewood, Ohio. <br /> <br />(c) "Council" shall mean the City Council of the City of <br /> Lakewood. <br /> <br />(d) <br /> <br />"Deteriorated or Deteriorating Area" shall mean an <br />area within the City which contains a majority of aged <br />structures, and where because of such concentration of <br />aged structures public programs providing for the <br />maintenance and repair, or rehabilitation or improve- <br />ment of such structures are necessary to be carried <br />out in order to prevent the development or spread of <br />conditions constituting blight throughout said area, <br />and in addition which area also contains a substantial <br />nu~er of structures which by reason of age, deteri- <br />oration or dilapidation are detrimental to the public <br />health, safety and welfare because a substantial <br /> <br /> <br />
