ORDINANCE NO. 30-93 BY: Boscia, George, Gibbons, Roth, Seelie, Smith AN EMERGENCY ORDINANCE to amend Sections 1721.02, 1721.04 and 1721.05 of the Sanitary Code of the Codified Ordinances of the City of Lakewood to establish licensing fees for public swimming pools, public spas and special use pools in accordance with rules promulgated by the Ohio Department of Health. WHEREAS, the City requires any operator of a public or private swimming pool to obtain a license from the City, and WHEREAS, the Ohio Department of Health has promulgated rules affecting the licensing of public swimming pools, spas and special use pools, and WHEREAS, the City of Lakewood, Division of Health, is required to issue said licenses in cOnformity with those rules, and WHEREAS, this ordinance provides for the preservation of the public health, safety and welfare, and for the usual daily operation of a municipal department in 'that Ohio law requires the licensing of public pools, public spas, and special use pools in accordance with rules promulgated by the State Department of Health; now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 1721.02 of the Sanitary Code of the Codified Ordinances of the City of Lakewood, be amended by the enactment of new subsections (g) and (h) to read as follows: 1721.02 DEFINITIONS. (b) . . (d) . (e) . . . (f) · (g) "Public spa" means any public swimming pool that is typically operated as a smaller, higher temperature pool for recreational or non-medical uses. 1. "Smaller" means less than five thousand gallons in volume. 2. "Higher temperature" means greater than ninety degrees Fahrenheit. (h) "Special use pool" means a public swimming pool containing flume slides, wave generating equipment or other special features that necessitate different design and safety requirement. "Special use pool" does not include any water slide or wave generating pool at a public amusement area which is licensed and inspected by the Ohio Department of Agriculture, pursuant to R.C. Sections 1711.50 to 1711.57. As used in this paragraph: "Special features" includes, but is not limited to, a flume slide, a playground-type slide, wave generating equipment, or a raindrop fountain or other water attraction.
