ORDINANCE NO. <br /> <br /> Placed on 1st Reading ~ Referred <br />Committee of the Whole 7/6/99. <br />Placed on Second Reading 7/19/99. <br /> <br />tO <br /> <br /> BY: Corrigan, Fitz6erald, <br />Roth, Seelie, Skindell, Smith <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor to enter into an Agreement <br />between the City of Lakewood ("City") and Lakewood Hospital Association ("Hospital") which <br />further defines the Amended and Restated Lease by and between the City of Lakewood and <br />Lakewood Hospital Association, entered into on December 23, 1996 ("Lease"). <br /> <br /> WHEREAS, the Hospital has been operating the EMS system for the City, using <br />ambulances purchased by the City in accordance with the Lease; and <br /> <br /> WHEREAS, the City of LakewoOd will be converting from a Hospital based EMS service <br />to a Fire based EMS service; and <br /> <br /> WHEREAS, due to the conversion from a hospital based EMS service to a Fire based <br />EMS service, the obligations of the parties relative to the provision of EMS services, need to be <br />redefined as stated in the Lease; and <br /> <br /> WHEREAS, this Ordinance is hereby declared to be an emergency measure immediately <br />necessary for the preservation and enhancement of the public peace~ health, safety and <br />welfare of the City of Lakewood. <br /> <br />BE TT ORDAINED BY THE CTI-Y OF LAKEWOOD, 5-TATE OF OHIO <br /> <br />Section 1. The IVlayor is hereby authorized to enter into the Agreement Between City <br />of Lakewood and Lakewood Hospital Association ("Agreement"), attached hereto as <br />Exhibit A, on behalf of the City of Lakewood. · <br /> <br />Section 2. That any part of the Amended and Restated Lease by and between the <br />City of Lakewood and Lakewood Hospital Association which is in conflict with this <br />Agreement is superceded by the Agreement. <br /> <br />Section 3. It is fOund and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberation of the Council and of any of its <br />committees that resulted in such formal action were in meetings open to the public in <br />compliance with all legal requirements. <br /> <br />Section 4. That this ordinance is hereby declared to be an emergency measure for <br />the reasons stated in the preamble hereof and provided it receives the affirmative vote <br />of two-thirds of all members elected to Council, it shall take effect and be in force <br />immediately upon its adoption and approval by the Mayor; otherWise, it shall take effect <br />and be in force after the earliest period allowed by law. <br /> <br />Adopted: JJ~ ~1/~ <br /> <br />Approved: <br /> <br />President <br /> <br /> <br />
