<br /> AN EMERGENCY ORDINANCE to amend Chapter 1321 of the Codified
<br />Ordinances of the City of Lakewood to eliminate the municipal licensing of specialty
<br />contractors and to require the registration of said contractors pursuant to House Bill
<br />.434.
<br />
<br /> WHEREAS, the state legislature passed House Bill 434; this Bill became Law
<br />Mamh 21,2001 and is effective September 17, 2001; and
<br />
<br /> WHEREAS, this Statute provides for a statewide license under which heating,
<br />ventilating and air conditioning contractors, refrigeration contractors, electrical
<br />contractors, plumbing contractors and hydronics contractors who engage in commercial
<br />construction can obtain a Single state-issued license to conduct business in Ohio; and
<br />
<br /> WHEREAS, this Statute provides for testing at the state level and prohibits
<br />municipal corporations or boards of county commissioners from imposing examinations
<br />or additional skill,related requirements on these specialty trade contractors except for
<br />contractors Wishing to'conduct work on one, two and three family properties; and
<br />
<br /> WHEREAS, the Statute only permits municipalities to require registration of a
<br />state licensed contractor, a fee for said registration, proof of bonding and insurance,
<br />compliance with Workers' Compensation Laws, and registration with the municipal tax
<br />department; and
<br />
<br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto
<br />determines that this ordinance is an emergency measure, and that this ordinance shall
<br />take effect at the eadiest date possible as set forth in ARTICLE III, SECTONS 10 and
<br />13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it
<br />is necessary for the immediate preservation of the public property, health and safety,
<br />and to provide for the usual daily operation of municiPal departments in that_House Bill
<br />434 will go into effect September 17,2001. Now Therefore,
<br />
<br />BE IT ORDAINED BY THE CITY OF LAKEWOOD:
<br />
<br /> Section 1. That existing Chapter 1321 of the Codified Ordinances of the City
<br />of Lakewood, now reading as follows:
<br />
<br />CHAPTER 1321. LICENSING OF ELECTRICIANS AND HEATING AND/OR AIR
<br />CONDITIONING CONTRACTORS AND PLUMBERS.
<br />
<br /> 1321.01 LICENSING REQUIREMENT.
<br /> (a) No person, corporation, partnership, firm or other business association
<br />shall, acting in the capacity of a contractor, engage in heating and/or air conditioning
<br />work, electrical work or plumbing work, without first obtaining a license for each trade
<br />from the Building Commissioner.
<br />
<br /> (b) "Contractor", for the purpose of this section, means any person,
<br />corporation, partnership, firm or other business.~,~sociation who performs any work
<br />specified above for consideration evidenced by an oral or written agree, nent. No
<br />corporation; partnership, firm or other business association shall engage in work for
<br />which a license is required, unless at least one responsible member, officer or
<br />
