ORDINANCE NO. 114-02 BY: <br /> <br />PLACED ON 1ST READING & RE~ERRED TO <br />THE COMMITTEE OP THE WHOLE 6/3/02. <br />PLACED ON 2ND READING 6/17/02. <br />Corrigan, Dunn, FitzGerald, George, <br />Roth, Seelie, Sktndell. <br /> <br /> AN EMERGENCY ORDINANCE providing for the submission to the electors <br />of the C'~y of Lakewood, an amendment to Artide XIV, Section i(A), Board of <br />Building Standards and Building Appeals, of the Second Amended Charter of the <br />City of Lakewood to allow the appointing authority to remove any member of the <br />Board of Building Standards and Building Appeals for cause. <br /> <br /> WHEREAS, in November, 2000, the electors of the C~:y of Lakewood <br />adopted the Second Amended Charter; and <br /> <br /> WHEREAS, the Second Amended Charter provides that the appointing <br />authority may remove any member of the Planning Commission and the Board of <br />Zoning Appeals for cause, while only the Mayor has the authority to remove a <br />member of the Board of Building Standards and Building Appeals; and <br /> <br /> WHEREAS, pursuant to the Amended Charter of the City of Lakewood and <br />the Constitution of the State of Ohio, the Coundl has determined to authorize <br />and direct the submission to the electors of the City of Lakewood of the <br />proposed Second Amended Charter, attached hereto and incorporated herein es <br />'Exhibit A," at the general election to be held on Tuesday, November 7, 2000, <br />which election is not less than 60 nor more than 120 days from the effective date <br />of this Ordinance; and <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected <br />thereto determines that this ordinanceis an emergency measure, and that this <br />ordinance shall take effect at the earliest date possible as set forth in ARTICLE <br />[II, SECI'ONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CTrY OF <br />LAKEWOOD, and that it is necessary for the immediate preservation of the public <br />property, health and safety, and to provide for the usual daily operation of <br />municipal departments in that this Ordinance must be transmitted to the <br />Cuyahoga County Board of Bections not less than 60 nor more than 120 days <br />from the November 5, 2002 election. Now Therefore <br /> <br /> BE 1-1' ORDAINED BY THE COUNCIL OF THE C2't'Y OF LAKEWOOD~ STATE <br />OF OHIO; TWO-THIRDS OF THE MEMBERS OF COUNC[L~ CONCURI:~NG: <br /> <br /> Section 1. That this Coundl hereby determines to authorize and direct <br />the submission to the electors of the City of Lakewood at the general election to <br />be held at the usual places of voting in the City on Tuesday, November 5, 2002, <br />the proposed amendment to Article X~V, Section i(A) as stated below. <br /> <br /> Section 2. The Board of Elections of Cuyahoga County is hereby. <br />directed to submit the following question to the electors of the C~y at the <br />general election on November 5, 2002: <br /> <br />Shall Artide Xi~, Section I(A), Board of Building Standards and Building <br />Appeals of the Second Amended Charter of the City of Lakewood, Ohio be <br />amended to read as follows? <br /> <br /> There shall be a Board of Building Standards and Building Appeals, <br />composed of five (5) members, who shall be appointed for term of five <br />years each. Three (3) members of the Board shall be appointees of the <br />Mayor, and two (2) members of the Board shall be appointees of Coundl. <br />Members of the Board shall be ineligible to succeed themselves unless the <br />member is completing a term for which be or she was appointed to fill <br />mid-term vacancy.
