AN EMERGENCY ORDINANCE providing for the submission to the electors of the C'~y of Lakewood, an amendment to Artide XIV, Section i(A), Board of Building Standards and Building Appeals, of the Second Amended Charter of the City of Lakewood to allow the appointing authority to remove any member of the Board of Building Standards and Building Appeals for cause. WHEREAS, in November, 2000, the electors of the C~:y of Lakewood adopted the Second Amended Charter; and WHEREAS, the Second Amended Charter provides that the appointing authority may remove any member of the Planning Commission and the Board of Zoning Appeals for cause, while only the Mayor has the authority to remove a member of the Board of Building Standards and Building Appeals; and WHEREAS, pursuant to the Amended Charter of the City of Lakewood and the Constitution of the State of Ohio, the Coundl has determined to authorize and direct the submission to the electors of the City of Lakewood of the proposed Second Amended Charter, attached hereto and incorporated herein es 'Exhibit A," at the general election to be held on Tuesday, November 7, 2000, which election is not less than 60 nor more than 120 days from the effective date of this Ordinance; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinanceis an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE [II, SECI'ONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CTrY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments in that this Ordinance must be transmitted to the Cuyahoga County Board of Bections not less than 60 nor more than 120 days from the November 5, 2002 election. Now Therefore BE 1-1' ORDAINED BY THE COUNCIL OF THE C2't'Y OF LAKEWOOD~ STATE OF OHIO; TWO-THIRDS OF THE MEMBERS OF COUNC[L~ CONCURI:~NG: Section 1. That this Coundl hereby determines to authorize and direct the submission to the electors of the City of Lakewood at the general election to be held at the usual places of voting in the City on Tuesday, November 5, 2002, the proposed amendment to Article X~V, Section i(A) as stated below. Section 2. The Board of Elections of Cuyahoga County is hereby. directed to submit the following question to the electors of the C~y at the general election on November 5, 2002: Shall Artide Xi~, Section I(A), Board of Building Standards and Building Appeals of the Second Amended Charter of the City of Lakewood, Ohio be amended to read as follows? There shall be a Board of Building Standards and Building Appeals, composed of five (5) members, who shall be appointed for term of five years each. Three (3) members of the Board shall be appointees of the Mayor, and two (2) members of the Board shall be appointees of Coundl. Members of the Board shall be ineligible to succeed themselves unless the member is completing a term for which be or she was appointed to fill mid-term vacancy.
