ORDINANCE NO. 58-03 BY: Corrigan, Dever, Dnnn, FitzGerald <br /> George, Roth, Seelie <br /> <br /> An EMERGENCY ORDINANCE providing that the petition for referendum with <br />respect to Ordinance No. 38-03 be submitted to a vote of the electors of the City of Lakewood, <br />pursuant to Article XXI, Section 1 of the Second Amended Charter of the City of Lakewood. <br /> <br /> WHEREAS, on May 19, 2003, the Council of the City of Lakewood passed Ordinance <br />No. 38-03 authorizing the execution of a development agreement relating to the West End <br />Redevelopment Area and declaring improvements to certain parcels of real property to be a public <br />purpose as outlined in section 725.02 of the Ohio Revised Code; requiring the owners of those <br />parcels to make urban renewal service payments in lieu of taxes; establishing a tax incentive <br />review council; and authorizing the execution of various contracts, certifications and other <br />documents related thereto; and <br /> <br /> WHEREAS, the Clerk of Council, through verification by the Cuyahoga County Board of <br />Elections, has certified that the Petition for Referendum contains a sufficient number of validated <br />signatures pursuant to Article XXI, Sections I and 6 of the Second Amended Charter; and <br /> <br /> WHEREAS, Lakewood City Council,. pursuant to Article XXI, Section 6 hereby <br />reconsiders Ordinance No. 38-03 and finds that such Ordinance shall stand as adopted and shall <br />not be repealed, but rather, shall be submitted to a vote of the electors; and <br /> <br /> WHEREAS, Lakewood City Council has determined to authorize and direct that <br />Ordinance No. 38-03 be submitted to the electors of the City of Lakewood at the general election <br />to be held on Tuesday, November 4, 2003; and <br /> <br /> WHEREAS, this Co'uncil by a vote of at least five (5) members elected thereto determines <br />that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest <br />date possible as set forth in ARTICLE m, SECTONS 10 and 13 of the SECOND AMENDED <br />CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate <br />preservation of the public property, health and safety, and to provide for the usual daily operation <br />of municipal departments in that this Ordinance must be transmitted to the Cuyahoga County <br />Board of Elections to be timely prepared for the August 21, 2003 submission deadline for the <br />November 4, 2003 general election. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE <br />OF OHIO: <br /> <br /> Section 1. That this Council hereby determines to authorize and direct the submission <br />to the electors of the City of Lakewood at the general election to be held at the usual places of <br />voting in the City on Tuesday, November 4, 2003, Ordinance No. 38-03 as stated below. <br /> <br /> Section 2. The Board of Elections of Cuya.hoga County is hereby directed to submit <br />the following Ordinance to the electors of the City at the general election on November 4, 2003: <br /> <br />ORDINANCE 38-03 <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor or her designee to enter <br />into a Development Agreement relating to the West End Redevelopment Area and <br />declaring improvements to certain parcels of real property to be a public purpose as <br />outlined in section 725.02 of the Ohio Revised Code; requiring the owners of those <br />parcels to make urban renewal service payments in lieu of taxes; establishing a tax <br />incentive review council; and authorizing the execution of various contracts, certifications <br />and other documents related thereto. <br /> <br /> For The Ordinance <br />__ Against The Ordinance <br /> <br /> <br />
