Please Substitute for Ordinance 126- <br />05 placed on first reading and referred to the <br />Committee of the Whole 12/19/05: Placed <br />on second reading 1/3/06 <br /> <br />ORDINANCE NO. 126-05 <br /> <br />BY{ Butler, Demro, Dever, FitzGerald, <br /> Madigan~ Seelie <br /> <br /> AN EMERGENCY ORDINANCE to amend Chapter 107 of the Lakewood Codified Ordinances, <br />entitled ~'Publication 0f Legal Notices" for the purposes of updating and bri6ging into consistency <br />with the Zoning Code. <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto determines <br />that this ordinance is an emergency measure, and that this ordinance shall take effect at the <br />earliest date possible as set forth in ARTICLE III, SECTIONS :tO AND :[3 of the SECOND AMENDED <br />CHARTER OF THE C~OF LAKEWOOD, and that it is necessary for the preservation of the public <br />properS, health and safety, and to provide for the usual daily operation of municipal departments. <br />Now Therefore, <br /> <br />BE Z'I' ORDAINED BY THE C~TY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That e)dsting Section 107.01 - Legal Notice in Newspaper or by Posting - of <br />the Codified Ordinances of the City of Lakewood, which now reads as follows: <br /> <br />When publication of municipal ordinances, resolutions, statements, orders, <br />proclamations, notices and reports is required to be by posting, copies thereof shall be <br />posted in not less than five (5) of the most public places in the City for a period of not <br />less than fifteen (15) days. Council determines that the five (5) most public places in <br />the City are: <br /> <br />(a) <br />(b) <br /> <br />(c) <br />(d) <br />(e) <br /> <br />Municipal Departments and Administration Building, Aaministrative Section; <br />Municipal Departments and Administration Building, Police Headquarters <br />Section; <br />Fire Engine House No. 1, 1418 Warren Road; <br />Fire Engine House No. 2, 18124 Detroit Avenue, and <br />Fire Engine House No. 3, 1418 Hopkins Avenue. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />When publication of municipal ordinances, resolutions, statements, orders, <br />proclamations, notices and reports is required to be by posting, copies thereof shall be <br />posted in not less than five (5) of the most public places in the City for a period of not <br />less than fifteen (15) days. That existing Section 107.02 - Legal Notice in Newspaper or by Posting - of <br />the Codified Ordinances 0fthe City of Lakewood, which now reads as follows: <br /> <br />(a) Pursuant to Article III, Section 12 of the Second Amended City Charter, and <br /> notwithstanding any contraw definition or provision of the Ohio Revised Code, <br /> the Lakewood Ledger, Lakewood Sun-Post, Cleveland Plain Dealer and <br /> cleveland Press are each hereby determined to be a newspaper of general <br /> circulation within the City of Lakewood¢ and the Cleveland Plain Dealer and <br /> Cleveland Press are each hereby determined to also be a newspaper of <br /> general circulation with Cuyahoga County. <br />(b) ... <br /> <br />1 of 3 <br /> <br /> <br />
