AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Council otherwise, It shall take effect and be in fore after the eariiest period allowed by law, amending Ordinance 55-07, adopted Juiy 2, 2007, estabiishing a Land Reutilization Program for the City of Lakewood. WHEREAS, The Land Reutilization Program was previously estabiished by the Lakewood City Council; and WHEREAS, There are additional avenues for the acquisition of property for the Land Reutilization Program at iittle or no cost to the City of Lakewood that were not refiected in the prior ordinance; and WHEREAS, It could benefit the City to be able to acquire additional parcels of real estate for redevelopment; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the eariiest date possibie as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it provides for the usual daily operation of municipal departments in that the Department of Planning and Development is charged with furthering the planned development or redevelopment of the City. NOw, therefore ¡ I é BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Ordinance No. 55-07, adopted July 2, 2007, currently reading as follows: l Section 1. That the City of Lakewood hereby declares that there exists sufficient and substantial nonproductive land within its boundaries which is of such nature and extent as to necessitate the impiementation of a Land Reutilization Program to foster either the return of such nonproductive land to tax revenue generating status or the devotion thereof to pubiic use. Section 2. That the City of Lakewood hereby adopts and implements the procedures set forth in Chapter 5722 of the Ohio Revised Code. Section 3. That the Department of Pianning and Development shall administer the Land Reutilization Program. Section 4. That the Director of Planning and Development shall implement poiicies and procedures, as approved by the Director of Law, that are consistent with this Ordinance and Chapter 5722 of the Ohio Revised Code for the disposition of Land held in the City's Land Reutilization Program (Land Bank). Section 5. That the Cierk of Council is hereby directed to send certified cOpies of this Ordinance to the County Auditor, County Treasurer, and County Prosecutor as provided in Section 5722.02 of the Ohio Revised Code.
