<br />- (s r <br />ý'LflLC¡Þ ON <br />R",Aß/¡V(¡ I' ~t;;-¡:t:¡tIZEJ ,<0 <br /> <br />(0l» 313{oy'2f'p t¡/"".{/ <br /> <br />ORDINANCE NO: <br /> <br />1-1-02 <br /> <br />BY: Antonio, Bullock, Butler, <br />Dever, Powers, Summers.Madigan <br /> <br />AN ORDINANCE authorizing the Mayor or his designee to enter into a Real Property <br />Sale Agreement with Board of Education of the Lakewood City Schools and to receive One <br />Dollar ($1.00) for the sale of penn anent parcel 314-11-052 located on Franklin Boulevard <br />Lakewood, Ohio. <br /> <br />WHEREAS, the City of Lakewood, as a result of the action by Lakewood City Council, <br />shall hold title in fee simple to the property located on Franklin Boulevard (PP# 314-11-052) <br />Lakewood, Ohio; and <br /> <br />WHEREAS, it is in the public interest to see that this property be at its highest and best <br />use; and <br /> <br />WHEREAS, the Board of Education of the Lakewood City Schools "Designing Our <br />Schools for the Next Fifty Years" school facilities project desires to purchase said parcels for the <br />expansion and redevelopment of the current Lakewood High School site; and <br /> <br />WHEREAS, the Planning Commission at its meeting of February 5, 2008 unanimously <br />voted to approve and refer to City Council final approval of said sale of the aforementioned <br />parcel to the Board of Education of the Lakewood City Schools; and <br /> <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />detennines that this ordinance is an emergency measure, and that this ordinance shall take effect <br />at the earliest date possible as set forth in ARTICLE III, SECTIONS 10 and 13 of the SECOND <br />AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that immediate action is <br />necessary in order to facilitate the school project. <br /> <br />NOW THEREFORE BE IT ORDAlNED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section I. The Council of the City of Lake wood hereby authorizes the Mayor or his <br />designee to enter into a Real Property Sale Agreement with Board of Education of the Lakewood <br />City Schools and to receive One Dollar ($1.00) for the sale of the property located on Franklin <br />Boulevard (PP3 14-1 1-052) Lakewood, Ohio. <br /> <br />Section 2. That the following describes the property to be sold to the Board of <br />Education of the Lakewood City Schools Pennanent Parcel Number 314-11-052: <br /> <br />Situated in the City of Lake wood, County of Cuyahoga, State of Ohio and known as being a part <br />of Original Rockport Township Section Number 22, Township 7 North, Range 14 West, part of <br />Lot 145 of the Walton Brothers Lakewood Heights Allotment as recorded in Plat Volume 25, <br />Page 14, also being a portion of a parcel ofland conveyed to the City of Lake wood, Volume <br />2271, Page 476, of said County's records, and being further bounded and described as follows: <br /> <br />Commencing at the southeast corner of said Lot 145 and the northeast corner of Lot 144 in said <br />Walton Brothers Lakewood Heights Allotment, said corner being on the west line of vacated <br />Robinwood Ave. (Ordinance No. 77-68), said corner also being the TRUE PLACE OF <br />BEGINNING of the parcel of land hereinafter described, thence clockwise along the following <br />four (4) courses and distances: <br />
