AN ORDINANCE to take effect immediately provided it received the affirmative vote of at least flue (5) members elected to Council otherwise, it shall take effect and be in force after the earliest period allowed by- law, to amend Chapter 903, Sidewalks and Curbs of the Codified Ordinances of the City of Lakewood to update enforcement and inspections contained within this Chapter. WHEREAS, the City is in the process of redeveloping the Sidewalk Program; and WHRFAS, it is appropriate to review and update Chapter 903, Sidewalks and Curbs of the Codified Ordinances of the City of Lakewood as part of that process; and WHEREAS, permit fees have not been increased since 1964; and WHEREAS, this Council by a vote of at least flue (5) members elected theReto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CItY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal department ih that these changes should take effect immediately as we are already into the construction season. Now Therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD,.STATE OF OHIO Section 1. That Chapter 903, Sidewalks and Curbs, of the Codifed Ordinances of the City of Lakewood, currently reading as follows: 903.01 COMPLIANCE WITH SIDEWALK SPECIFICATIONS. In order to have all sidewalks in the streets and alleys within the City constructed and repaired in a reasonably uniform manner all,such sidewalks hereafter to be laid-and all repairing hereafter to be done shall be done in conformity with the requirements of this chapter. 903.02 SIDEWALK CONFORMITY TO STREET GRADE; EXCEPTION. All sidewalks shall be laid to conform to the established grade of the street and shall slope so as to coincide with the followin described line: beginning at the top of the curb at the established grade and extend~ng thence td the fence line or property line at an incline upward from such curb at the rate of three-eights of an inch for each foot. At street intersections where the grade of streets renders such slope impracticable, the sidewalks shall be laid under the direction and to the acceptance of the City Engineer. For the replacement or repair of segments of sidewalk where the abutting sidewalk does not have the prescribed incline, the sidewalks shall be laid under the direction and to the acceptance of the City Engineer. 903.03 SIDEWALK WIDTHS. On all streets and alleys of not less than thirty-three or more than forty feet in width, the sidewalks shall be not less than four feet wide. On aII streets not less than forty nor more than sixty feet in width all sidewalks shall be not Tess than five feet wide. On all streets more than sixty feet wide and on all main streets or east and west thoroughfares, except Clifton Boulevard, all sidewalks shall be not less than. six feet wide. However, on any street which is not a main street or an east and west thoroughfare, but is nevertheless devoted entirely to residences, the sidewalks shall be not less than five feet wide. On Clifton Boulevard, all sidewalks shall be not less than five feet wide. Where trees within the public. right of way render it impossible or impractical for the sidewalks to be constructed in accordance with the above prescribed sidewalk widths, such sidewalks shall be constructed under the direction of and to the acceptance of the Director of Public Works. 903.04 STONE FLAGGING SPECIFICATIONS. Good sawed stone flagging is deemed acceptable material for sidewalks, but in no case shall it be less than two and one-half inches thick. No flagging shall be less
