ORDINANCE N0. >.{5_Q9 45-09 <br />PLEASE SUBSTITUTE FOR ORDINANCE <br />N0. 45-09 PLACED ON 1ST READING & REFERRED <br />TO TAE RULES & ORDINANCES COMMITTEE 4/20/0' <br />PLACED ON 2ND READING 5/4/09. <br />gy; Antonio, Bullock, Butler, <br />Dever, Madigan, Powers, Suers. <br />AN ORDINANCE to take effect immediately provided it received the affirmative <br />vote of at least flue (5) members elected to Council otherwise, it shall take effect and <br />be in force after the earliest period allowed by- law, to amend Chapter 903, Sidewalks <br />and Curbs of the Codified Ordinances of the City of Lakewood to update enforcement <br />and inspections contained within this Chapter. <br />WHEREAS, the City is in the process of redeveloping the Sidewalk Program; and <br />WHRFAS, it is appropriate to review and update Chapter 903, Sidewalks and Curbs of <br />the Codified Ordinances of the City of Lakewood as part of that process; and <br />WHEREAS, permit fees have not been increased since 1964; and <br /> <br />WHEREAS, this Council by a vote of at least flue (5) members elected theReto <br />determines that this ordinance is an emergency measure, and that this ordinance shall take <br />effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the <br />SECOND AMENDED CHARTER OF THE CItY OF LAKEWOOD, and that it is necessary for the <br />immediate preservation of the public property, health and safety, and to provide for the usual <br />daily operation of municipal department ih that these changes should take effect immediately <br />as we are already into the construction season. Now Therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD,.STATE OF OHIO <br />Section 1. That Chapter 903, Sidewalks and Curbs, of the Codifed <br />Ordinances of the City of Lakewood, currently reading as follows: <br />903.01 COMPLIANCE WITH SIDEWALK SPECIFICATIONS. <br />In order to have all sidewalks in the streets and alleys within the City constructed <br />and repaired in a reasonably uniform manner all,such sidewalks hereafter to be laid-and <br />all repairing hereafter to be done shall be done in conformity with the requirements of <br />this chapter. <br />903.02 SIDEWALK CONFORMITY TO STREET GRADE; EXCEPTION. <br />All sidewalks shall be laid to conform to the established grade of the street and <br />shall slope so as to coincide with the followin described line: beginning at the top of <br />the curb at the established grade and extend~ng thence td the fence line or property <br />line at an incline upward from such curb at the rate of three-eights of an inch for each <br />foot. At street intersections where the grade of streets renders such slope <br />impracticable, the sidewalks shall be laid under the direction and to the acceptance of <br />the City Engineer. <br />For the replacement or repair of segments of sidewalk where the abutting <br />sidewalk does not have the prescribed incline, the sidewalks shall be laid under the <br />direction and to the acceptance of the City Engineer. <br />903.03 SIDEWALK WIDTHS. <br />On all streets and alleys of not less than thirty-three or more than forty feet in <br />width, the sidewalks shall be not less than four feet wide. On aII streets not less than <br />forty nor more than sixty feet in width all sidewalks shall be not Tess than five feet wide. <br />On all streets more than sixty feet wide and on all main streets or east and west <br />thoroughfares, except Clifton Boulevard, all sidewalks shall be not less than. six feet <br />wide. However, on any street which is not a main street or an east and west <br />thoroughfare, but is nevertheless devoted entirely to residences, the sidewalks shall be <br />not less than five feet wide. <br />On Clifton Boulevard, all sidewalks shall be not less than five feet wide. <br />Where trees within the public. right of way render it impossible or impractical for <br />the sidewalks to be constructed in accordance with the above prescribed sidewalk <br />widths, such sidewalks shall be constructed under the direction of and to the <br />acceptance of the Director of Public Works. <br />903.04 STONE FLAGGING SPECIFICATIONS. <br />Good sawed stone flagging is deemed acceptable material for sidewalks, but in <br />no case shall it be less than two and one-half inches thick.
