Please <br />substitute for the original. <br />ORDINANCE N0.7-13 BY: Anderson, Bullock, Suris, <br />Madigan, Nowlin, Powers, Smith. <br />AN ORDINANCE to take effect immediately provided it receives the affirmative <br />vote of at least five members of Council, or otherwise to take effect and be in force after <br />the earliest period allowed by law, amending Section 301.04, Bicycle; Motorized Bicy- <br />cle; Section 373.02, Riding upon Seats; Handle Bars; Hehnets and Glasses; Section <br />373.04, Riding Bicycles and Motmroycles Abreast; Section 373.06, Lights and Reflector <br />on Bicycle; Brakes; and Section 373.10, Riding on Sidewalk, of the Codified Ordinances <br />of the City of Lakewood to define and regulate the operation of bicycles. <br />WHEREAS, the types of vehicles resembling those traditionally defined as bicy- <br />cles that are being manufactured and put into use on roadways has increased; and <br />WHEREAS, following a recent change to the Ohio Revised Code's definition of <br />"bicycle," the Traffic Code within the Codified Ordinances stands to be modified in order <br />to recognize and accommodate these types of vehicles while still clarifying bicycles vis- <br />a-vis toy vehicles; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits <br />municipalities to exercise all powers of local self-government and to adopt and enforce <br />within their limits such as local police, sanitary and other regulations as are not in conflict <br />with general laws; and <br />WHEREAS, this Council by a vote of at least five members thereof determines <br />that this ordinance is an emergency measure, and that this ordinance shall take effect at <br />the earliest date possible as set forth in Article III, Sections 10 and 13 of the Second <br />Amended Charter of the City of Lakewood, and that it is necessary to provide for the <br />usual daily operation of municipal departments in that new bicycle-related vehicles are <br />currently in operation on City streets; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Section 301.04, Bicycle; Motorized Bicycle, of the Codified Ordi- <br />nances of the City of Lakewood, currently reading as follows: <br />301.04 BICYCLE; MOTORIZED BICYCLE. <br />(a) "Bicycle" means every device, other than a tricycle designed solely <br />for use as a play vehicle by a child, propelled solely by hmnan <br />
