ORDINANCE NO. 9- 13' - -_A BY: Anderson, Bullock, Juris, Madigan, Nowlin, Powers, Smith. AN ORDINANCE amending Section 902.12, Homestead Exemption, and Section 915.03, Homestead Exemption, and repealing Section 913.25, Homestead Exemption Sewer Rates, of the Codified Ordinances of the City of Lakewood to further clarify the income requirements necessary to qualify for the water and sewer rate exemptions offered therein, and to remove inconsistencies within the code. WHEREAS, questions have arisen within the administration as to what income must be counted when calculating the homestead exemption; and WHEREAS, the language in the homestead exemption ordinances should be amended to clarify the income requirements and eligibility for the homestead exemption; and WHEREAS, Section 913.25 is inconsistent with the later- modified Section 902.12 and thus stands to be repealed; now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: Section 1. Section 902.12, Homestead Exemption, of the Codified Ordinances of the City of Lakewood, currently reading as follows: 902.12 HOMESTEAD EXEMPTION. There is hereby established a Special Homestead Exemption whereby sewer rates charged to homesteads owned by person 65 years of age or older or owned by a permanently or totally disabled person provided that such person's income falls below $35,000 per ammm shall be 75% of the sewer rate established pursuant to this chapter. shall be and is hereby amended to read as follows: 902.12 HOMESTEAD EXEMPTION. There is hereby established a Sspecial Hhomestead Eexemption whereby sewer rates charged to homesteads a dwelling unit owned and occupied by a person 65 years of age or older or owned and occupied by a permanently or totally disabled person, provided that such person's the sum of all income of all adults occupying the dwelling unit falls below $35,000 per annum, shall be 75% of the sewer rate established pursuant to this chapter. For the purposes of this section, "income" shall have the same meaning as in Section 128.03101. Section 2.
