RESOLUTION NO. 4-569 BY: Mess~s. Gaydos, Hu£fman, Kelle~ Usher, Ward, Mendling, Cain AN EMERGENCY RESOLUTION declaring it necessary to improve certain properties in the City of Lakewood for off-street parking of motor vehicles by the acquiring of real estate, demolition of existing building%grading, paving, curbing, lighting, fencing and providing drainage facilities together with necessary appurtenances thereto and widening Carabel Avenue in connection therewith. WHEREAS, this Council by two-thirds vote of the members elected there- to determines that this resolution is an emergency measure which is necessary for the immediate preservation of the public peace, property, health and safety and for the further reason that the improvements herein provided are immedi- ately necessary to eliminate existing hazards to vehicular traffic using the streets of this City and conditions which could cause blight; and WHEREAS, this Council has received a petition requesting the improve- ment described in this resolution signed by all owners of property to be assessed therefor; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Lakewood, Cuyahoga County, State of Ohio, three-fourths of all members elected thereto concurring: Section 1. That it is necessary to improve in the City of Lakewood the following properties: Situated in the City of Iakewood, County of Cuyahoga and State of Ohio, and known as being part of Sublots Nos. 81, 82 and 84 in The N. F. W. Bailey Re-Subdivision of part of Original Rockport Township Section No. 19, as shown by the recorded plat in Vol,~me 58 of Naps, Page 23 of Cuyahoga County Records, and together forming a parcel of land bounded and described ~ follows~: Beginning on the Easterly side of Carabel Avenue, at the Southwesterly corner of Sublot No. 84; thence Northerly along the Easterly side of Carabel Avenue~ 40 feet to the Southwesterly corner of a parcel of land conveyed to The Cleveland Trust Company by deed dated June 5, 1939 and re- corded in Volume 4963, Page 669 of Cuyahoga County Records; thence Easterly along the Southerly line of said parcel so conveyed, 134feet to its intersection with the Northerly prolongation of an Easterly line of Sublot No. 84; thence Southerly along said Northerly prolongation and along said Easterly line of Sublot No. 84, 40 feet to the Southeasterly corner thereof; thence Westerly along the Southerly line of Sublot No. 84, 1~4 feet to the place of begimn~ng, as appears by said plat, be the same more or less, but subject to all ~kegal highways; and Situated in the City of Lakewood, County of Cuyahoga and State of Ohio and known as being Sublot No. 85 in the N. F. W. Bailey Re-Subdivision of part of Original Rockport Township Section No. 19, as shown by the recorded plat of said Re-Subdivision in Volume 58 of Maps, Page 2~ of CRyahoga County Records, and having a frontage of 40 feet on the Easterly side of Carabel Avenue, and extending back of equal width 134 feet deep, as appears by said plat, be the same more or less, but subject to all legal highways.
