AS AMENDED APRIL 5, 1982 <br /> <br /> RESOLUTION N0. 5fi ~ BY:Brown, Chinnock, McBride, <br /> Salmon, Wendling <br /> AN EMERGENCY RESOLUTION determining to amend Resolution 5619 in order <br /> to review the property owners share of the cost of improving the following <br /> streets: <br /> 1. Reveley Avenue (Madison to Athens Avenue); <br /> 2. Lakewood Heights Boulevard (Alger Road to 180 feet west of Olive <br /> Avenue); <br /> 3. McKinley Avenue (Hilliard Road to Riverside Drive); and <br /> 4. Alger Road (Warren Road to Lakewood Heights Boulevard), <br /> and to deleate Belle Avenue (Madison Avenue to Franklin Avenue) from the 1982 <br /> street resurfacing program. <br /> WHEREAS, this Council has heretofore on December 7, 1981, adopted <br /> Resolution No. 5619 declaring it necessary to improve portions of Jackson <br /> Avenue, Lincoln Avenue, Giel Avenue, Lakewood Heights Boulevard, Selle Avenue, <br /> McKinley Avenue, Cove Avenue, Lewis Drive, Reveley Avenue, and Alger Road by <br /> removal, where necessary, of the existing surface course, by grading and <br /> replacement where necessary, of the base and by resurfacing with asphaltic <br /> concrete including the necessary replacement and resetting of castings together <br /> with necessary appurtenances thereto, and <br /> WHEREAS, in the aforesaid Resolution 5619 this Council determined <br /> that those tote with frontage so benefited by said improvements shall be <br /> assessed as the rate of $5.00 per foot of frontage, and <br /> WHEREAS, the Board of Revision of Assessments at its hearing on March <br /> 25, 1982, determined that the damage to Reveley Avenue (Madison Avenue to <br /> Athens Avenue) was caused in part by an unusual and extraordinary amount of <br /> truck and heavy vehicle traffic generated by commercial deliveries to the <br /> nearby neighborhood shopping area and that the damage to Lakewood Heights <br /> Boulevard (Alger Road to 180 feet west of Olive Avenue), McKinley Avenue <br /> (Hilliard Road to Riverside Drive) and Alger Road (Warren Road to Lakewood <br /> Heights Boulevard) was caused by the extreme increase in use of said streets as <br /> the result of traffic patterns generated by the use of I-90 and that these <br /> streets have virtually become marginal roads to Interstate 90 rather than <br /> strictly residential streets as the term is ordinarily used; and the Board has <br /> directed that the property owners portion be reduced to $4.50 per front footage <br /> on Reveley Avenue and that no assessment be made on property abutting Lakewood <br /> Heights Boulevard, McKinley Avenue and Alger Road and that the entire cost of <br /> said improvement be paid for by the City, and <br /> WHEREAS, the Board of Revision and Assessments has further advised <br /> this Council that the majority of the residents of Belle Avenue (Madison Avenue <br /> to Franklin Avenue) feel that Belle Avenue should be deleated from the 1982 <br /> resurfacing program because of the current on-going hospital construction and <br /> for the further reason that the roadway is repairable and need not be improved <br /> this year, to which this Council concurs, and <br /> WHEREAS, This Council by two-thirds vote of the members elected <br /> thereto determines that this Resolution is an emergency measure which is <br /> necessary for the immediate preservation of the public peace, property, health, <br /> and safety and for the further reason that the improvements provided in <br /> Resolution 5619 is immediately necessary to eliminate existing hazards to <br /> vehicular traffic using the streets of the City; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />
