REFERRED TO PUBLIC WORKS COMMITTEE 5/19/03. <br /> <br />RESOLUTION NO. 7765-03 <br /> <br />BY: Corrigan, Dever, Dunn, <br />FitzGerald, George, Roth, Seelie. <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Mayor, on behalf of the City of <br />Lakewood, to enter into agreements with the Ohio Department of Transportation <br />providing for the resurfacing of West Clifton Boulevard (SR-237/US-20). <br /> <br /> WHEREAS, on .luly 1, 2002, the City of Lakewood enacted legislation proposing <br />cooperation with the Director of Transportation for the described project: <br /> <br /> Apply face to face curb surface treatment of West Clifton BoUlevard from <br />approximately Riverside Drive to Clifton Boulevard a total distance of 0.74 miles more or <br />less lying within the City of Lakewood. Total work length of project being <br />approximately 1.08 miles; and <br /> <br /> WHEREAS, the City of Lakewood shall cooperate with the Director of <br />Transportation in the above described project as follows: <br /> <br /> The City agrees to assume and bear one hundred percent (100%) of the <br /> entire cost of the improvement, less the amount of Federal-aid and State <br /> funds set aside by the Director of Transportation for the financing of this <br /> improvement from funds allocated by the Federal Highway Administration, <br /> U.S. Department Transportation. <br /> <br /> That the Director of Transportation proceed with, as part of the highway <br /> improvement, the installation and/or repair of curb ramps which are <br /> necessary to ensure compliance with the Americans with Disabilities Act <br /> and the City shall bear and assume one hundred percent (100%) Of the <br /> cost of such installation and/or repair. <br /> <br /> In addition~ the City also agrees to assume and bear one hundred percent <br /> (100%) of the cost of any construction items requested by the City on the <br /> entire improvement, which are not necessary for the improvement, as <br /> determined by the State and Federal Highway Administration. <br /> <br />The share of the cost of the City of Lakewood is now estimated in the amount of I ighty <br />Thousand Dollars ($80,000.00), but said estimated amount is to be adjusted in or ler <br />that the City of Lakewood's ultimate share of said improvement shall correspond v~ith <br />said percentage of actual costs when said actual costs are determined; and <br /> <br /> WHEREAS, the Director of Transportation has approved said legislation <br />proposing cooperation and has caused to be made plans and specifications and a~ <br />estimate of cost and expense for improving the above described highway and ha,~ <br />transmitted copies of the same to this legislative authority; and <br /> <br /> WHEREAS, the City of Lakewood desired the Director of Transportation to <br />proceed with the'aforesaid highway improvement; and <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this resolution is an emergency measure, and that this resolution shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 ;~nd <br />13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safer ~,, and <br />to provide for the usual daily operation of municipal departments in that agreemE ~nts <br /> <br /> <br />
