Baker, Bullock, Kepple, Litten, <br />RESOLUTION N0.2022-28 BY: Marx, Rader, Shachner <br />A RESOLUTION to take effect immediately provided it receives the vote of at least two thirds <br />of the members of Council, or otherwise to take effect at the earliest period allowed by law, to <br />call on the Ohio Legislature and Congress to act to protect abortion rights in the wake of the <br />Supreme Court's reversal of Roe v. Wade and Planned Parenthood v. Casey. <br />WHEREAS, on June 24th, 2022 the Supreme Court of the United States overturned Roe <br />v. Wade, and Planned Parenthood v. Casey, rolling back the clock 50 years, ending federal <br />protection of abortion, and stripping abortion rights from individuals at the federal level; and, <br />WHEREAS, this decision allows states to restrict or outright ban abortion procedures and <br />many state governments, including Ohio's, are moving quickly to enact laws that ban abortion or <br />severely limit access to abortion; and, <br />WHEREAS, abortion restrictions have a disproportionate impact on Black, Indigenous, <br />and other people of color, the young, people with disabilities, LGBTQ and non -binary people, as <br />well as those living in Appalachia and other rural communities; and, <br />WHEREAS, it is our responsibility as local lawmakers to do everything within our power <br />to protect the rights and liberties of our residents; and, <br />WHEREAS, Congress has the authority to codify the right of individuals to obtain a safe <br />and legal abortion; and, <br />WHEREAS, Ohio Joint Resolution 5 would enact Section 22 of Article I of the <br />Constitution of the State of Ohio to present a Constitutional Amendment to Ohio voters <br />guaranteeing every individual in Ohio a fundamental right to reproductive freedom including, <br />but not limited to, prenatal care, childbirth, postpartum care, contraception, sterilization, abortion <br />care, miscarriage management, and infertility care; and, <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />resolution is an emergency measure and that it shall take effect immediately, and that it is <br />necessary for the immediate preservation of the public property, health, and safety and to <br />provide for the usual daily operation of municipal departments in that the June 24, 2022 <br />Supreme Court ruling is a direct threat to Lakewood residents; Now, therefore, <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. That the City of Lakewood calls on the Ohio General Assembly to pass Ohio <br />Joint Resolution 5, with all deliberate speed, to place the Constitutional Amendment on the <br />November 8th General Election ballot. <br />
