ORDINANCE N0. 84-11 <br />Page -4- <br />misdemeanor of the first degree for each subsequent offense within one <br />(1) year after conviction for the first offense. <br />(f) In addition to the penalties set forth in subsection (e) <br />hereinabove, the Lyndhurst Municipal Court shall order the owner or <br />person in custody or possession of any dog which is determined by the <br />Court, based upon the evidence adduced during the course of a prose- <br />cution for an offense .under this Section, to be a continued nuisance <br />or which constitutes a serious threat to the health, safety, and <br />welfare of the public to immediately and permanently remove such dog <br />from the municipality. If the dog is not immediately and permanently <br />removed from the Village then the Court may order the Animal Warden of <br />the Village to cause the animal to be impounded and removed. <br />505.12 Quarantine of Animals <br />(a) Whenever it is established that any dog or other animal has <br />bitten any person, or shows signs of being inf ected with rabies, the <br />owner of such animal, upon order of the Animal Warden or Chief of <br />Police, shall quarantine said animal in the County Dog Kennels of <br />Cuyahoga County or in a veterinarian's kennels for a period of ten <br />(10) days from date of such order, at the cost and expense of the <br />owner of such animal. <br />(b) In the event that the owner of such animal fails to comply <br />with the order provided for in paragraph (a) of this Section-, within <br />six (6) hours after such order has been issued and served upon such <br />owner, the Animal Warden or any police officer of the Village may take <br />such animal into custody and place the same in quarantine at the <br />expense of the owner. <br />505.13 Animals Running at Large <br />(a) No person being the owner of any animal shall permit such <br />animal to run at large or to run upon the premises of another without <br />the permission of such other person. <br />(b) No person being the owner of a dog shall permit such dog to <br />go beyond the premises of such owner at any time when the dog is in <br />heat, unless such dog is properly restrained by a leash, cord, chain, <br />or similar device. The owner of any dog in heat shall at all times <br />keep such dog either confined upon the premises of the owner or under <br />reasonable control of some person. <br />(c) The running at large of any animal in or upon any of the <br />places mentioned in this Section is prima facie evidence that it is <br />running at large in violation of this Section. <br />~,.. <br />
