M.V. ORDINANCE N0. 84-11 <br />Pabe -3- <br />505.09 Disposition of Dogs <br />Dogs which have been seized by the Animal Warden <br />shall be kept, housed and fed for three (3) days. At <br />of such time, unless previously redeemed by the owner <br />animal shall be surrendered to the County Dog Pound of <br />County, Ohio. <br />505.10 Records and Receipts <br />and impounded <br />the expiration <br />thereof, such <br />Cuyahoga <br />A record of all dogs impounded, the disposition of same, the <br />owners' name and address, if known, and a statement of impounding fees <br />and costs assessed against such dogs shall be kept by the Animal <br />Warden and a copy thereof shall be furnished to the Director of <br />Finance together with all monies received as a result of such <br />impounding fees and costs. <br />505.11 Vicious Dogs <br />(a) The following definitions shall apply specifically to this <br />Section: <br />(1) A.vicious dog is "unconfined" as the term is used in this <br />Section if such dog is not restrained by a secure fence, other <br />secure enclosure, or other'security device which effectively <br />prevents such dog from going beyond the premises of the person <br />described in subsection (c) hereof. <br />(2) A "vicious dog" means: <br />(A) Any dog with a propensity, tendency or disposition to <br />attack, to cause injury to or to otherwise endanger the <br />safety~of human beings or other animals;. <br />(B) Any dog which attacks a human being or other animal without <br />provocation. <br />(C) Any pit bull terrier which is defined as any Staffordshire <br />bull terrier breed of dog which contains as an element of <br />its breeding the breed of Staffordshire bull terrier or <br />American Staffordshire terrier as to be identifiable as <br />partially of the breed of Staffordshire bull terrier or <br />American Staffordshire terrier by a qualified veterinarian <br />duly licensed as such by the State of Ohio. <br />(b) Subsections (c) and (d) hereinbelow.are necessary controls on <br />the unrestrained activity of vicious dogs which threaten the safety <br />and pleasantness of streets, parks, sidewalks, yards, and all other <br />areas of the Village and lack of knowledge or lack of intent is not a <br />defense to a violation thereof. <br />(c) No person owning or having the care or control of a vicious <br />dog shall permit such animal to go unconfined on the premises of such <br />person. <br />(d) No person owning or having the care or control of a vicious <br />dog shall permit such dog to go beyond the premises of such person'- <br />unless the do_g is securely restrained by a leash, cord, chain or other <br />similar device. <br />(e) Whoever violates any provision of this Section is guilty of a <br />second degree misdemeanor on a first offense but shall be guilty of a <br />
