Carmen <br />AN ORDINANCE CREATING SECTION <br />139.04 OF THE CODIFIED ORDINANCES <br />OF HAYFIELD VILLAGE DEALING WITH <br />THE DISPOSITION OF PROPERTY HELD BY <br />THE POLICE DEPARTMENT. <br />WHEREAS, Section 2933.41 of the Ohio Revised Code <br />establishes a procedure for the disposition of property held by law <br />enforcement agencies; and <br />WHEREAS, Section 2933.41 (F) of the Ohio Revised Code further <br />provides that said Section does not rescind or restrict the authority <br />of a municipal law enforcement agency to keep and dispose of lost, <br />abandoned, stolen, seized or f orf eited property under an ordinance of <br />the municipal corporation; now, theref ore, <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. There is hereby created Section 139.03 of the <br />Codified Ordinances of Mayfield Village, Ohio, which shall read as <br />follows: <br />139.04 DISPOSITION OF PROPERTY HELD BY POLICE DEPARTMENT. <br />(A) Personal property which has been lost, abandoned, <br />stolen, or lawfully seized or forfeited, and which is in <br />the custody of the Police Department, shall be safely kept <br />pending the time it is no longer needed as evidence, and <br />disposed of pursuant to this Section. <br />(B) The Police Department shall make a reasonable <br />effort to locate the persons entitled to possession of <br />property in its custody, and to notify them when and <br />where it may be claimed. In the absence of evidence <br />identifying persons entitled to custody, it is sufficient <br />notice to advertise in a newspaper of general circulation <br />in the County for two (2) consecutive weeks, said advertise- <br />ment to briefly describe the nature of the property in <br />custody and inviting persons to view and establish their <br />right to possession of said property. <br />(C) A person loses any right he may have to possession <br />of property : <br />(1) Which was the subject, or was used in a <br />conspiracy or attempt to commit, or the commission <br />
