M.V. ORDINANCE N0. 84 -31 <br />Page -2- <br />of, an offense other than a traffic offense, and <br />such person is a conspirator, accomplice or <br />offender with respect to the offense; <br />(2) When, in light of the nature of the property <br />or the circumstances of such person, it is unlawful <br />for him to acquire or possess it. <br />(D) Unclaimed, forfeited and seized property in the custody <br />of the Police Department shall be disposed of by the Chief of <br />Police, with the approval of the Mayor, as follows: <br />(1) Drugs shall be destroyed or placed in custody <br />of the Secretary of the Treasury of the United States <br />for disposal or use for medical or scientific purposes <br />under applicable federal law. <br />(2) Firearms and dangerous ordnances suitable for <br />police work may be retained by the Police Department <br />for that purpose or given to another law enforcement <br />agency for that purpose. Firearms and dangerous <br />ordnances may also be sold to licensed firearms <br />dealers as a credit against the purchase of firearms, <br />dangerous ordnances or amunition for use in the <br />Police Department. All other firearms and dangerous <br />ordnances not retained or otherwise disposed of as <br />specified in this paragraph shall be destroyed. <br />(3) Obscene materials shall be destroyed. <br />(4) Other unclaimed or forfeited property may be <br />sold at public auction or otherwise disposed of as <br />the Chief of Police, with the approval of the Mayor, <br />considers proper in the circumstances. <br />(E) The proceeds from property disposed of pursuant to this <br />Section shall first be used for the purposes set forth in <br />Paragraph (D)(2) hereinabove. After the of orementioned purposes <br />have first been fulfilled, all other proceeds shall be placed <br />in the General Fund of the Village. <br />(F) This Section does not apply to the collection, <br />storage or disposal of abandoned junk motor vehicles. This <br />Section shall not be construed to rescind or restrict the <br />authority of the Police Department to keep and dispose of lost, <br />abandoned, stolen, seized or forfeited property under any <br />other applicable ordinance or law. <br />
