<br />EXHIBIT "B" <br />AGREEMENT <br />This Agreement, made and entered into this day of <br />, 1982 by and between the <br />, and the , political <br />subdivisions of the State of Ohio. <br />WHEREAS, it is desirable that each of the respective parties <br />hereto have such additional fire protection which may be afforded by <br />the equipment, apparatus and personnel of the other party, when, because <br />of circumstances, such additional aid may appear necessary; and <br />WHEREAS, by Resolution No. 82-12 , duly passed by the <br />Council of the Mayfield Village on the 15th day of <br />February , 1982 , and by Resolution duly <br />passed by the Council of the , on <br />the day of, 198 -, the parties hereto <br />were authorized to enter into a contract for the mutual interchange <br />of fire protection services. <br />1. Each party hereto shall respond to the emergency call of <br />the officer on duty in charge of the Fire Department of the calling <br />party hereto for fire protection assistance insofar as such assistance <br />is consistentwith the proper protection of the territory of the responding <br />Fire Department, such assistance to be determined in the judgment of <br />the officer in charge of the responding Fire Department. <br />2. M:en an officer of a Fire Department calls for assistance <br />he shall state the specific emergency and the equipment and manpower <br />needed. When assistance is called for the officer requesting such <br />assistance shall give explicit directions as to the location where <br />assistance is needed and shall, whenever possible, dispatch someone <br />to a specific meeting place to escort the persons responding to their <br />'destination. 3. It is further mutually agreed that all personnel of the <br />responding party, while responding to a call of the calling party, shall <br />be acting within the scope of their employment as fire personnel while <br />enroute to, enroute from, and while acting within tYie territory of the <br />calling municipality. <br />4. Tt is further agreed that no charge shall be made for this <br />service by either party'. In no case shall the party herein called upon <br />or rendering such service be liable in damages to the other party to <br />this Agreement, or its residents, or contractual obligees, for failure <br />to answer any fire call or for lack of speed in answering such call <br />or for inadequacy of equipment, negligent operation of eciuipment, or €or any cause whatsoever growing out of use of such fire equiTment <br />and firefighters. The party which issued such call shall not be liable <br />in any manner or event for damages or loss of equipment or personnel
