M.V. RESOLUTION N0. 82- 73 <br />Page -2- <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1.. The Mayor and Council do hereby ratify their previous <br />action in eclaring August 27, 28, and 29, 1982 as "Beta Days" in <br />the P4t. Vernon Campus Parko <br />Section 2. On the.aforesaid dates only, the following terms <br />and con it?were applicable to the Mt. Vernon Campus Park: <br />(a) Any of the businesses in the Mt. Vernon <br />Campus Park were permitted to conduct retail sales, <br />provided that five percerit (5%) of a11 gross sales <br />were to be paid to the Village for the Community Room <br />Construction Project; <br />(b) The retail sales were to be conducted on <br />August 27, 1982 from 5:00 P.M. until 9:00 P.M. for <br />Village residents only and on August 2$, 19$2 and <br />August 29, 1982 from 9:00 A.M. until 5:00 P.M. for the <br />general public; <br />(c) Any expenses incurred for security personnel <br />or police personnel, whether for traffic control or <br />otherwise, were to be borne solely by the participating <br />businesses. <br />Section 3. The Mayor ancl Council do hereby expressly determine <br />that the Beta Days" eventratified herein was established on the dates <br />indicated as a one-time opportunity to aid the businesses in the Nlt. <br />Vernon Campus Park and is not to be construed as establishing the <br />intent of the Mayor anci Council to conduct such events in the future <br />or o.n a continuing basis. <br />Section 4. That the Council finds and determines that a11 <br />formal actions of this Council relating to the adoption of this <br />Resolution have beeri takeri at open meetings of this Council; and <br />that deliberations of this Council and of itscommittees, resulting <br />in such formal action, took place in meetings open to the public, in <br />compliance with a11 statutory requirenients, including the requirements <br />of Section 121,22 of the Ohio Revised Code. <br />Section 5. This Resolution is hereby declared to be an emergency <br />measure imme iately necessary for the'preservation of the health, <br />safety, and welfare of the residerits of Mayfield Village for the reason <br />that the event ratified hereinhas already beeri conducted and it is in <br />the best interest of the municipality to have such action ratified <br />formally by the Mayor and Council.
