RESOLUTION rIO. 82-81 (As Amended) <br />Page -4, <br />(b) Failure to pay any taxes due to Mayfield <br />Village in connection with the business of the <br />Permittee; <br />(c) Operation of the business autliorized by this <br />Permit in a manner determined by the Planning and <br />Zoning Commission and Council to be detrimerital to the <br />health, safety, morals or welfare of the residents of <br />Mayfield Village or in such a manner as to constitute <br />a nuisance, or permitting the grounds or buildings <br />to become unsafe or unsightly; <br />(d) Abandonment of the use of the premises as an <br />auto body repair shop or towing service for automobiles <br />for a continuing period of one (l) year or longer. <br />12. The Permit granted herei.n shall be effective only <br />so long as the Permittee remains an occu pant of the subject <br />premises. <br />Section 4. The Permittee shall have no more than ninety (90) <br />days to.comply with any violation of the terms and conditions set <br />forth hereinabove, said ninety ('90) day period to commence after <br />the Permittee receives writteri notice from the inunicipa].ity of such <br />violation. <br />Section 5. The Special Use Permit granted here"in shall be in <br />force an effect for a period of three (3) years following the effective <br />date of this Resolution. <br />Section 6. Any Ordinance or Resolv.tion in conflict with this <br />Resolution, whetHer in whole or in part, is hereby repealed to the <br />ex.tent necessary to avoid conflict witli this Resolution. <br />Section 7. Th.at the Council finds and determines that a11 <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at operi me.etings of this Council; and <br />that deliberations of this Council and of its committees, resulting <br />in such forrnal action, took place in meetings operi to tlie p.ublic, <br />in compliance with all statutory requiremerits, including the require- <br />ments of Section 121.22 of the Ohio Revised Codeo Section 8. This Resolution is hereby declared to be an <br />emergency measure immediately necessary for th:e preservation of the <br />health, safety and welfare of the residerits of Mayfield Village in <br />that it wi11 help insure tlie nuisance free operation of a commercial <br />enterprise in a residential neighbortiood thereby protecting the <br />values of the neighboring property.
