M.V. RESOLUTION N0. 82- 83 <br />Page -2- ' <br />Section 1. For the reasons set forth hereinabove, the <br />Council "here y authorizes the Finance Director to inake payment to <br />Joseph A. Palermo and Violet L. Palermo the sum of Two Hundred Fifty <br />Three Dollars 'I'wenty Three'Cerits ($253.23) as reimbursement for <br />overpayment of property taxes resulting from the erroneous transfer <br />of the entire of parcel no. 831-1-17 to said parties. <br />Section 2. The paymerit authorized herein is in consideration <br />for the a ready executed quit-claim deed wlierein the Palermos transfered <br />to the municipality all of their right, title and interest in and to <br />the rear portion of the said parcel which should have originally been <br />retained by the municipality. <br />Section 3. The Direetor of Law is hereby authorized and <br />directed to forward the payment to the Palermos along with a full <br />release indicating that upon negotiation of a settlement check the <br />Palermos sha11 release the municipality from any and all claims and <br />demands of whatever nature arising fram or in any way connected with <br />erroneous transfer of the.subject premises as set forth hereinabove. <br />Section 4. That the Council finds and determines that a11 <br />formal actions of this Council relating to the adoption of this <br />Resolution have been takeri at operi meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requiremerits, including the requirements <br />of Section 121.22 of the Ohio ReUised Code. <br />Section 5e This Kesolution is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />health, safety and welfare of the residerits of MayfieTd Village for <br />the reason that the paymerit authorized here'in is necessary to effect <br />equity in the erroneous transfer of property and to protect the <br />integrity of the municipal.itye 2't shall therefore take effect immediately <br />upon passage by the affirmata;ve vote'of not less than five (5) members <br />elected to Council and approval by the Mayor or otherwise at the <br />earliest time allowed by lawo -do <br />First Readinge_ <br />Second Reading: <br />Third Reading:_ <br />PASSED : 10/4/ -2 <br />. <br />. <br />APPROVED : <br />API'ROVED AS TO <br />ATTEST : :/cs _ge-c. <br />OCTOBER 4th 1Suspended <br /> <br />Suspended
