ORDINANCE N0. 82- 95 <br />INTRODUCED BY: Mayor & Council as a Whole <br />AN CRDINANCE PROVIDING FOR THE EMPLOYMENT <br />OF AN ENGINEER FOR MAYFIELD VILLAGE, OHIO, <br />AND DECLARING AN EMERGENCY. <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section l. Stephen Hovancsek is hereby employed and <br />appointe as Engineer for Mayfield Village until December 31, 1983, <br />or until his successor is appointed by the Mayor and confirmed by <br />not less than four members of Council, such employment to be <br />terminable by either the Village or said Engineer upon 90 days <br />written notice to the other. However, all work, if same is being <br />processed in a manner satisfactory to the Village, shall be <br />completed by the Engineer and the services therefor paid by the <br />Village, in accordance with the terms hereof. <br />Section 2. Said Stephen Hovancsek shall be compensated as <br />follows, an the Mayor and the Clerk are hereby authorized to enter <br />into an Agreement in writing with said Stephen Hovancsek whereby he <br />will be paid on the following basis: <br />(a) If the proceedings for any improvement are completed <br />according to the usual schedule, as provided by law, so that the <br />bids are received and a contract is awarded, he shall be paid a <br />sum equal to seventy-five percent (75P/o) of the amount listed in <br />Section 2(b); as the work progresses, he shall receive additional <br />compensation equal to the balance of the fee listed in Section 2(b); <br />said sum to be paid at the time the contractor's estimates, upon <br />which his payment is based, are preserited for payrient. Before the <br />final estimate for the work is issued, any adjustment shall then <br />be made so that the total fee paid him shall be equal to the <br />percentages listed in Section 2(b). <br />(b) That for such services in connection with construction <br />of public improvements, he shall receive compensation on a percentage <br />for the actual cost of construction of all improvements made by <br />Council or under their control. <br />General Engineeri?ng Projects - Schedule I <br />Airports and Facilities <br />Bridges and Gracl.e Separation Structures <br />Foundations <br />Dams and Hydraulic Structures <br />Highway and City Streets <br />Street Reconstruction <br />Incinerators <br />Intercepting, Relief, Storm or Sanitary Sewers <br />Outside Electrical Installations <br />Power Plants
