ORDINANCE NO. 81-13 Page -5- (D) Building setback lines shall be consistent with those already existing to prevent any proposed building from taking a position of greater prominence or visibility than any existing building unless a waiver of such uniformity shall have been first obtained from the owners of all existing buildings within one thousand (1,000) feet of the boundary of the proposed development property on the side on which the setback variance is proposed, but such waiver shall not be binding on the Planning and Zoning Commission or on Village Council. Section 2. All of those certain lands in Mayfield Village bounded by S.O.M. Center Road on the east, Wilson Mills Road on the south, and Beta Drive on the east and north are hereby rezoned to be governed, in addition to the existing zoning regulations, by the provisions of Chapter 1175 of the Codified Ordinances, Industrial Park District. Section 3. .The Clerk is authorized, empowered and directed to certify a copy of this Ordinance to the Board of Elections of Cuyahoga County, Ohio, to be placed before the electorate at a special election to be held within the municipality on June 2, 1981, or as soon thereafter as the regulations of the Board of Elections may allow, in. the manner provided by the Charter of Mayfield Village for proposed changes in the zoning ordinance or map of Mayfield Village. Section 4. This Ordinance, providing. for automatic referendum pursuant to the Charter of Mayfield Village, shall take effect immediately upon passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor, or otherwise at the earliest time allowed by law.
