M.V. ORDINANCE NO. 81-13 <br />k~age ~4 -~ <br />Section 1175.13 Review by Council. The Planning Commission <br />shall report its action on the final development plans to the <br />Council of the Village which shall, within thirty (30) days, <br />review such action. Council may affirm, modify or reject the <br />action of the Planning Commission but the Planning Commission <br />shall be deemed to have been affirmed unless modification or <br />rejection is approved by the affirmative vote of not less than <br />five (5) members elected to Council. <br />Section 1175.15 Building Permits. Upon final development <br />plan approval, the Building Commissioner shall be authorized to <br />issue building permits consisting therewith upon determination <br />by the Building Commissioner that all buildings and uses are <br />the same as those on the final development plans and that the <br />proposed construction of buildings and uses complies with the <br />Building Code and with all other applicable governmental <br />regulations. At any time after the approval of the final <br />development plans, the developer may request amendment of his <br />plans by filing an application with the Building Commissioner <br />for such amendment, which shall be subject to review by the <br />Planning Commission and Council in the same manner as the <br />original application. <br />Section 1175.15Protection for Adjacent Property Owners. In <br />no event shall final development plans be approved for a development <br />in an industrial park district where such plans provide for any <br />of the following: : <br />(A) Buildings,. whether, main or accessory, parking or <br />`.loading areas, or driveways within three hundred (300) feet <br />of any existing single family residence; <br />(B) A building height more than ten (10) feet above the <br />maximum permitted height for a similar type building under <br />Chapter 1169 or Chapter 1173 of the Codified Ordinances; <br />(C) A use which the Planning and Zoning Commission <br />deems to be detrimental to any nearby property owner. To <br />facilitate such determination, Planning and Zoning Commission <br />shall notify the owners of all property within one thousand <br />(1,000) feet of the boundary of the proposed development <br />parcel of the filing of preliminary development plans and <br />the general nature of such proposed development. Upon <br />receipt of a written complaint from any such property owner, <br />Planning and Zoning Commission shall set a hearing at which <br />the Complainant and any other interested property owner may <br />testify before approving, modifying or rejecting the <br />preliminary development plan. Council shall be notified <br />of the date and time of said hearing and shall be permitted <br />to participate in the questioning of any witness; <br />
